Their initiative resulted in the re-establishment of the Expert Group on Liability whose work is being considered by the 11<\/span><\/i><i><span data-contrast=\"auto\">th<\/span><\/i><i><span data-contrast=\"auto\"> Session of the FCTC COP happening this November 15-22, 2025.<\/span><\/i><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The <\/span><a href=\"https:\/\/storage.googleapis.com\/who-fctc-cop11-source\/Main%20documents\/fctc-cop11-6-en.pdf\"><span data-contrast=\"none\">Expert Group\u2019s report<\/span><\/a><span data-contrast=\"auto\"> to the COP11 (EG) shows that implementation remains limited. Only a handful of Parties have fully implemented Article 19. Most see it only as litigation, which is often slow, resource-intensive, and inaccessible to many jurisdictions. Among others, the Expert Group (EG) recognized that alternative pathways are also important <\/span><b><span data-contrast=\"auto\">while <\/span><\/b><span data-contrast=\"auto\">emphasizing that civil and criminal actions continue to play a central role in establishing responsibility and securing meaningful remedies.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Recent discussions point to the need for clearer next steps, not just a generic recognition of the EG report and the importance of litigation, but also tools drawn from other sectors that could move Parties closer to making the tobacco industry <\/span><a href=\"https:\/\/tobaccocontrol.bmj.com\/content\/33\/e2\/e254\"><span data-contrast=\"none\">accountable<\/span><\/a><span data-contrast=\"auto\"> for harms caused.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">A strengthened approach to Article 19 includes specific calls for Parties to consider <\/span><a href=\"https:\/\/files.ggtc.world\/uploads\/2025-07-14\/16-14-08-169738\/Admin%20measures%20factsheetfv_19thApr.pdf\"><span data-contrast=\"none\">administrative<\/span><\/a><span data-contrast=\"auto\"> and fiscal measures. These include administrative sanctions that are effective, proportionate, and dissuasive\u2014allowing regulators to fine, suspend, or order corrective action against companies without waiting for lengthy judicial rulings. Countries may also make use of administrative tribunals in areas such as environment, corruption, or human rights; and fiscal mechanisms, such as levies (e.g., Gambia, Chad, and Benin\u2019s <\/span><a href=\"https:\/\/iris.who.int\/server\/api\/core\/bitstreams\/531014bb-58f7-4bd1-bbd8-0aefc07a44c5\/content\"><span data-contrast=\"none\">environmental tobacco taxes<\/span><\/a><span data-contrast=\"auto\">) or surcharges, to recover the public costs of tobacco-related disease, environmental clean-up, and enforcement, not too different from how countries enforce liability in the oil industry (International Oil Pollution Compensation Fund) or among ozone producers (Montreal Protocol). This demonstrates that fiscal liability for tobacco is both practical and precedented, though not yet coordinated globally.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In countries with limited judicial capacity, administrative and fiscal measures can be a practical starting point, but they should not limit or delay access to justice. These tools are meant to complement\u2014not create a barrier to\u2014civil or criminal actions, which remain significant for establishing responsibility, deterring \/ exposing misconduct, and denormalizing the tobacco industry. Emerging cases to recover environmental clean-up costs should also continue to be explored (e.g. <\/span><a href=\"https:\/\/www.publichealthlawcenter.org\/litigation-tracker\/baltimore-v-philip-morris-2022\"><span data-contrast=\"none\">Baltimore vs Philip Morris<\/span><\/a><span data-contrast=\"auto\">).<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Given the Expert Group\u2019s finding that implementation of Article 19 remains limited and that many Parties lack clarity on non-judicial options,<\/span><span data-contrast=\"auto\">*<\/span><span data-contrast=\"auto\"> Parties can benefit from technical information on feasible administrative and fiscal approaches, which may be developed by the Convention Secretariat or the WHO. Lessons from human rights, environmental, and anti-corruption systems\u2014where administrative enforcement is well established\u2014could offer practical models for Parties to consider. Guidance on cost-recovery formulas would further help countries estimate and justify levies or fees based on clear evidence. Administrative and fiscal mechanisms can be applied immediately, giving governments additional avenues to act and ensuring that the costs of harm are <\/span><a href=\"https:\/\/tobaccocontrol.bmj.com\/content\/33\/e2\/e254\"><span data-contrast=\"none\">borne<\/span><\/a><span data-contrast=\"auto\"> by the producer-polluter as early as possible, rather than only after lengthy court battles where companies may have diverted resources or even filed for bankruptcy (e.g., in <\/span><a href=\"https:\/\/www.newswire.ca\/news-releases\/industry-requests-a-twelfth-stay-5-years-of-litigation-stays-have-allowed-big-tobacco-to-maintain-business-as-usual-including-recruiting-new-addicts-850826168.html\"><span data-contrast=\"none\">Canada<\/span><\/a><span data-contrast=\"auto\">).<\/span><span data-ccp-props=\"{&quot;134233117&quot;:true,&quot;134233118&quot;:true,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Strengthening Article 19 in this way would make <\/span><a href=\"https:\/\/tobaccoliability.ggtc.world\/\"><span data-contrast=\"none\">liability<\/span><\/a><span data-contrast=\"auto\"> more accessible.
