It modified a previous law from 2006 that banned smoking in enclosed working environments but allowed it in certain bars and restaurants. <a href=\"http:\/\/www.bmj.com\/content\/341\/bmj.c6462\" target=\"_blank\">The tobacco lobby fought strongly against this change<\/a> as they were interested in exporting what was known as <a href=\"http:\/\/tobaccocontrol.bmj.com\/content\/early\/2011\/06\/09\/tc.2010.042275.abstract\" target=\"_blank\">\u201cthe Spanish model\u201d<\/a>: allowing smoking in places of entertainment maintained the social acceptance of a drug that kills 700,000 Europeans annually. To Big Tobacco\u00b4s dismay, <a href=\"http:\/\/www.bmj.com\/content\/342\/bmj.d617\" target=\"_blank\">the 2010 model soon spread to other countries<\/a>.<\/p>\n<p>According to the Spanish National Institute of Statistics, smoking prevalence has decreased from 26.2% in 2006 to 23.95% in 2012, the lowest rate in 25 years. <a href=\"http:\/\/www.plosone.org\/article\/info:doi\/10.1371\/journal.pone.0053722\" target=\"_blank\">Heart\u00a0attacks have dropped by 11% after the 2006 legislation was established<\/a>, so further drops are expected from 2010 on.\u00a0The EU Commission has stated that Spain has experienced the largest decrease in passive smoking of the EU over the last years: <a href=\"http:\/\/ec.europa.eu\/health\/tobacco\/docs\/smoke-free_implementation_report_en.pdf\" target=\"_blank\">70% less, well above the EU average of 46%<\/a>. In addition, 82% of the population \u2013including many smokers- agree with current legislation, says <a href=\"http:\/\/www.semfyc.es\/es\/componentes\/ficheros\/descarga.php?MTE2Mjk%3D\" target=\"_blank\">a poll by the Spanish Society of Family and Community Medicine (SEMFYC)<\/a>. In fact, social acceptance is increasing, according to <a href=\"http:\/\/www.msssi.gob.es\/estadEstudios\/estadisticas\/docs\/BS_2012\/B.S.2012res.graf.pdf\" target=\"_blank\">the last health barometer of the Ministry of Health, Social Services and Equality<\/a>.<\/p>\n<p>The current law has only been weakened once. It was done by the previous social democrat Government of Jose Luis Rodriguez Zapatero <a href=\"http:\/\/www.bmj.com\/content\/343\/bmj.d6332\" target=\"_blank\">following pressure from the largest Spanish department Store El Corte Ingl\u00e9s<\/a> to allow the sale of smoking products in convenience stores such as their Opencor chain. Now <a href=\"http:\/\/www.sands.com\/corporate-overview\/leadership\/sheldon-adelson\" target=\"_blank\">Sheldon Adelson, Las Vegas Sands casino chairman<\/a>, <a href=\"http:\/\/www.forbes.com\/profile\/sheldon-adelson\" target=\"_blank\">12th on the Forbes 400 list of the richest Americans<\/a> and one of the most important magnates of the gambling industry, has <a href=\"http:\/\/www.theguardian.com\/world\/2013\/feb\/08\/eurovegas-gambling-complex-madrid\" target=\"_blank\">announced the construction of the largest casino resort in Europe in the autonomous community of Madrid<\/a>, a project popularly known as Eurovegas. Adelson, whose company is <a href=\"http:\/\/www.propublica.org\/article\/inside-the-investigation-of-leading-republican-money-man-sheldon-adelson\" target=\"_blank\">under criminal investigation for possible violations of the U.S. Foreign Corrupt Practices Act<\/a>, and <a href=\"http:\/\/www.thedailybeast.com\/articles\/2013\/08\/28\/sheldon-adelson-pays-out-to-the-u-s-government.html\" target=\"_blank\">has just agreed to pay $47 million to the U.S. to settle a money-laundering case<\/a>, has requested that Spain\u2019s smokefree law be weakened to allow \u00a0smoking in the casino\u2019s premises. He promises that the casino project will create 200,000 jobs and bring prosperity to the region.<\/p>\n<p>Thus, the regional and national governments are salivating. Amendments to <a href=\"http:\/\/www.reviewjournal.com\/business\/casinos-gaming\/report-las-vegas-sands-could-delay-eurovegas\" target=\"_blank\">labor<\/a> and <a href=\"http:\/\/www.independent.co.uk\/news\/world\/europe\/mitt-romneys-backer-to-build-huge-18bn-eurovegas-resort-outside-madrid-8487859.html\" target=\"_blank\">urban planning laws and tax breaks<\/a> have already been negotiated. The repeated requests from the president of the autonomous community of Madrid, Ignacio Gonz\u00e1lez, from the conservative People\u00b4s Party (PP), <a href=\"http:\/\/ccaa.elpais.com\/ccaa\/2013\/09\/21\/madrid\/1379774458_379298.html\" target=\"_blank\">that the central government amends the law<\/a> seem to be having their effect. Recently the minister of health, social services and equality, Ana Mato, also from the PP, said that the Government is \u201clooking for ways\u201d to \u201creconcile the protection of health with the creation of jobs\u201d. In fact, according to the newspaper <a href=\"http:\/\/www.elmundo.es\/elmundo\/2013\/09\/26\/madrid\/1380157493.html\" target=\"_blank\">El Mundo<\/a>, the change has already been decided: smoking will be allowed in certain areas on all current 41 casinos throughout the country and on those to be built in Eurovegas. The daily <a href=\"http:\/\/www.larazon.es\/detalle_normal\/noticias\/3749068\/local+madrid\/eurovegas-tendra-su-ley-del-tabaco-en-un-mes#.UkQMYtIvVoE\" target=\"_blank\">La Raz\u00f3n<\/a> states that the law will be amended before November.<\/p>\n<p>The EU Commission considers that <a href=\"http:\/\/ec.europa.eu\/health\/tobacco\/docs\/smoke-free_implementation_report_en.pdf\" target=\"_blank\">the economic impact of banning smoking across the EU has been limited, neutral and even positive in bars and restaurants industry except for maybe on gambling premises<\/a>, a probably correct estimate according to <a href=\"http:\/\/tobaccocontrol.bmj.com\/content\/13\/3\/268.full\" target=\"_blank\">the available scientific literature<\/a>. However, the comorbidity between tobacco smoking and gambling seems clear. Tobacco might have neurochemical effects that enhance gambling behaviour (1) and problem gambling severity and amount of money spent, have been related to smoking (2). Must we create further death and disease to have jobs?<\/p>\n<p>Health professionals are fighting the change and the global community is watching. An umbrella platform of different tobacco control organizations (<a href=\"http:\/\/www.porquenosotrosno.com\/web\" target=\"_blank\">porquenosotrosno.org<\/a>) has launched the campaign <a href=\"http:\/\/www.porquenosotrosno.com\/web\/smoke-free-spain-en.html\" target=\"_blank\"><i>Don\u00b4t touch the law<\/i><\/a> to request international support to prevent the weakening of these public health protections. But the tobacco lobby\u00b4s tentacles remain long. The presidents of five autonomous communities in which tobacco is cultivated \u2013Extremadura, Andalusia, La Rioja, the Canary Islands and Cantabria- \u00a0<a href=\"http:\/\/www.20minutos.es\/noticia\/1817343\/0\/\" target=\"_blank\">recently signed a document opposing the new stronger Directive on tobacco control under discussion at the EU during a joint meeting celebrated in the headquarters of the tobacco company Altadis<\/a>. Meanwhile, according to members of the Directorate General for Health &amp; Consumers of the European Commission, there is a growing concern that <a href=\"http:\/\/blogs.wsj.com\/brussels\/2013\/06\/11\/john-dalli-you-become-a-pariah\/\" target=\"_blank\">former health commissioner John Dalli\u2019s resignation<\/a> may have been related to Big Tobacco\u2019s strategies.<\/p>\n<p>Health workers and other citizens must be aware of these manoeuvres and press health authorities at all levels that no concessions must be given to tobacco companies or others whose interests in profit threaten public health.<\/p>\n<p><b>References:<\/b><\/p>\n<p>1.- Mcgrath, DS and Barret, SP (2009), The comorbidity of tobacco smoking and gambling: A review of the literature.
