South Dakota&#8230; just Wow."},"content":{"rendered":"<p>I&#8217;m a bit bowled over by this. \u00a0There&#8217;s a <a href=\"http:\/\/legis.state.sd.us\/sessions\/2011\/Bill.aspx?File=HB1171HJU.htm\">Bill currently before the South Dakota legislature<\/a> that would, if passed, change the scope of justifiable homicide laws.<\/p>\n<blockquote><p>FOR AN ACT ENTITLED, An Act to\u00a0expand the definition of justifiable homicide to provide for the protection of certain unborn children.<br \/>\nBE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:<br \/>\nSection\u00a01.\u00a0That \u00a7 22-16-34 be amended to read as follows:<br \/>\n22-16-34.\u00a0Homicide is justifiable if committed by any person while resisting any attempt to murder such person,\u00a0<span style=\"text-decoration: underline\">or to harm the unborn child of such person in a manner and to a degree likely to result in the death of the unborn child,<\/span> or to commit any felony upon him or her, or upon or in any dwelling house in which such person is.<strong> <\/strong><br \/>\nSection\u00a02.\u00a0That \u00a7 22-16-35 be amended to read as follows:<br \/>\n22-16-35.\u00a0Homicide is justifiable if committed by any person in the lawful defense of such person, or of his or her husband, wife, parent, child, master, mistress, or servant<span style=\"text-decoration: underline\">, or the unborn child of any such enumerated person,<\/span> if there is reasonable ground to apprehend a design to commit a felony, or to do some great personal injury, and imminent danger of such design being\u00a0accomplished.<\/p><\/blockquote>\n<p>The underlining&#8217;s in the original. \u00a0The proposed section 22-16-34 seems to me to say that it&#8217;s justifiable homicide for \u00a0<em>A<\/em> to kill\u00a0<em>B<span style=\"font-style: normal\"> if <\/span>A<span style=\"font-style: normal\"> thinks<\/span><span style=\"font-style: normal\"><em> B<\/em> is about to kill them &#8211; but also that it&#8217;s justifiable for <\/span>A<span style=\"font-style: normal\"> to kill <\/span>B<span style=\"font-style: normal\"> if <\/span>A<span style=\"font-style: normal\"> is pregnant and thinks that <\/span>B<span style=\"font-style: normal\"> has laced her tea with abortifacient. \u00a0Well, I suppose that some kind of punishment is in order&#8230; but killing? \u00a0Could you not just tip the tea away and phone the police?<\/span><\/em><\/p>\n<p><em><span style=\"font-style: normal\">So that&#8217;s weird. \u00a0But the next section is jaw-dropping. \u00a0O<\/span><\/em>n the assumption &#8211; which seems reasonable &#8211; that being aborted could be seen as a &#8220;great personal injury&#8221; to a foetus in the eyes of the law (and being killed is a great personal injury if anything is), it seems to me that the proposed section 22-16-35 pretty much says that it&#8217;d be legally OK to kill a doctor if you believed that he was about to perform an abortion for your wife, mother, mistress, or servant, irrespective of her views on the matter. \u00a0You might also get away with killing that wife, mother, mistress or servant if the abortion is intentional.<\/p>\n<p>Put another way: it may not be criminal to kill someone for doing something perfectly legal, and which may be medically required. \u00a0Say what you like about the rights and wrongs of abortion &#8211; but that&#8217;s just <em>nuts<\/em>.<\/p>\n<p>(via <a href=\"http:\/\/scienceblogs.com\/pharyngula\/2011\/02\/its_gonna_be_open_season_on_ab.php\">PZ Myers<\/a>. \u00a0More coverage available via <a href=\"http:\/\/motherjones.com\/politics\/2011\/02\/south-dakota-hb-1171-legalize-killing-abortion-providers\">Mother Jones<\/a>.)<!--TrendMD v2.4.8--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>I&#8217;m a bit bowled over by this. \u00a0There&#8217;s a Bill currently before the South Dakota legislature that would, if passed, change the scope of justifiable homicide laws.
