{"id":4618,"date":"2025-01-15T12:04:46","date_gmt":"2025-01-15T11:04:46","guid":{"rendered":"https:\/\/blogs.bmj.com\/medical-ethics\/?p=4618"},"modified":"2025-01-15T12:04:46","modified_gmt":"2025-01-15T11:04:46","slug":"the-gmc-must-re-evaluate-its-treatment-of-climate-protesters","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/medical-ethics\/2025\/01\/15\/the-gmc-must-re-evaluate-its-treatment-of-climate-protesters\/","title":{"rendered":"The GMC must re-evaluate its treatment of climate protesters"},"content":{"rendered":"<p>By Rammina Yassaie.<\/p>\n<p>On 7 January this year, Bristol GP Patrick Hart, was <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cg525d9jlvlo\">jailed<\/a> for 12 months for damaging petrol pump screens, which he describes as <a href=\"https:\/\/thedoctor.bma.org.uk\/articles\/health-society\/doctor-jailed-for-climate-protest\/\">\u201can act of care\u201d<\/a> in protest against continued fossil fuel extraction; the environmental consequences of which are considered to be the greatest <a href=\"https:\/\/www.thelancet.com\/journals\/lanpub\/article\/PIIS2468-2667(24)00055-0\/fulltext#:~:text=This%20new%20report%20tracks%2042%20indicators%20highlighting%20the,protect%20or%20improve%20health%20with%20health-responsive%20climate%20action.\">health threat<\/a> of the 21<sup>st<\/sup> century.<\/p>\n<p>Hart\u2019s prison sentence was handed down in the same week the world looked on in horror at apocalyptic scenes of <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c0ewe4p9128o\">uncontrollable fires in California, which were undoubtedly exacerbated by climate change<\/a>. \u00a0As a result of his custodial sentence, Hart may become the <a href=\"https:\/\/thedoctor.bma.org.uk\/articles\/health-society\/doctor-jailed-for-climate-protest\/\">first practicing doctor<\/a> convicted for climate protest related offences to face suspension by the General Medical Council. Two clinically retired doctors, Sarah Benn and Diana Warner, have already been suspended.<\/p>\n<p>The <a href=\"https:\/\/www.bmj.com\/content\/343\/bmj.d6363\">GMC\u2019s primary duties<\/a> are to protect and promote the health and wellbeing of the public, whilst maintaining confidence and trust in the medical profession and upholding standards of practice.<\/p>\n<p><em>Maintaining confidence and trust<\/em><\/p>\n<p>The decision to suspend Benn and Warner has <a href=\"https:\/\/www.gmc-uk.org\/news\/news-archive\/statement-following-the-outcome-of-dr-sarah-benn-tribunal\">largely hinged on the assumption<\/a> that their actions may impact confidence and trust in the profession. For Hart, this unevidenced assumption could cost him his livelihood as a doctor.<\/p>\n<p>Is it not right that the burden of proof ought to lie with the GMC to prove that such actions do in fact hinder public trust, rather than relying on speculation about how the public may or may not react?<\/p>\n<p>And is it really true that trust in the profession would falter as a result of doctors acting in good faith, undertaking nonviolent direct action to sound the alarm on the threats of climate change to health?<\/p>\n<p>Notably, the <a href=\"https:\/\/www.gmc-uk.org\/-\/media\/documents\/promoting-and-maintaining-public-confidence-in-the-medical-profession---final-report_pdf-78718694.pdf\">GMC\u2019s own research<\/a> commissioned in 2019 found the public have \u201crelaxed\u201d views about criminal acts if undertaken in a non-work context. More specifically, that the GMC should base its regulatory response on whether: the behaviour impacts the doctor\u2019s clinical ability to practice safely; the doctor behaved dishonestly; and\/or whether a pattern of behaviour exists.<\/p>\n<p>It cannot reasonably be argued that climate protest impacts one\u2019s ability to practice medicine safely, and as with Benn and Warner, Hart has been <a href=\"https:\/\/thedoctor.bma.org.uk\/articles\/health-society\/doctor-jailed-for-climate-protest\/\">consistently honest<\/a> with the regulator and others, about his actions to date. The GMC expects these activists to <a href=\"https:\/\/www.bmj.com\/content\/387\/bmj.q1888\">express remorse<\/a> for their actions, which none, including Hart, <a href=\"https:\/\/theecologist.org\/2025\/jan\/08\/prison-fear-petrol-pump-protest-doctor\">feel morally able<\/a> to do. Surely their refusal to demonstrate remorse for their actions only reinforces their honesty and integrity as if they were to change their behaviours (which they have argued to be based on <a href=\"https:\/\/thedoctor.bma.org.uk\/articles\/health-society\/doctor-jailed-for-climate-protest\/\">conscience<\/a>), due to the personal and professional consequences they have faced &#8211; the public may, in fact, look down on that.<\/p>\n<p>More recent evidence also falls in favour of these doctors, rather than against them. This includes a public <a href=\"https:\/\/www.change.org\/p\/help-medical-professionals-keep-their-jobs-while-acting-on-the-climate-crisis\">petition<\/a> (with rising signatures) demanding they receive job protection, an <a href=\"https:\/\/www.pulsetoday.co.uk\/news\/regulation\/gmc-petitioned-to-reverse-climate-change-protest-doctor-sanctions\/\">open letter<\/a> from health, law and scientific communities calling on the GMC to reverse the existing suspensions, along with a (soon-to-be published) <a href=\"https:\/\/www.pulsetoday.co.uk\/news\/regulation\/doctors-association-to-gather-views-on-climate-change-gp-suspension\/\">survey<\/a> exploring public attitudes on this topic. This, along with supportive statements from the <a href=\"https:\/\/www.bma.org.uk\/bma-media-centre\/bma-responds-to-gmc-ruling-on-climate-protest-doctors\">British Medical Association<\/a> and the <a href=\"https:\/\/ukhealthalliance.org\/news-item\/gmc-find-doctor-protestors-fitness-to-practise-impaired-ukhacc-calls-on-the-council-to-find-ways-to-avoid-being-on-the-wrong-side-of-history\/\">UK Health Alliance on Climate Change<\/a>, who represent over 1 million health professionals, powerfully challenge the GMC\u2019s position that these actions are <a href=\"https:\/\/thedoctor.bma.org.uk\/articles\/health-society\/environmental-activist-gp-has-licence-suspended-after-blocking-traffic-on-m25\/\">viewed as \u201cdeplorable\u201d<\/a> by patients and peers.<\/p>\n<p><em>Upholding standards<\/em><\/p>\n<p><a href=\"https:\/\/www.gmc-uk.org\/professional-standards\/good-medical-practice-2024\">Good Medical Practice<\/a> sets out the standards of professional behaviours expected by UK doctors. While the latest standards do state that doctors \u201cmust follow the law\u201d, they also state that doctors \u201cmust act promptly if you think patient safety is, or may be seriously compromised\u201d which these activists would argue they are doing.<\/p>\n<p>The complexities of following potentially conflicting standards are acknowledged within the document itself, with a <a href=\"https:\/\/www.gmc-uk.org\/professional-standards\/the-professional-standards\/good-medical-practice\/about-good-medical-practice\">clear admission<\/a> that Good Medical Practice is <em>not<\/em> a set of rules. Rather, that doctors should use their \u201cprofessional judgement\u201d to apply the standards and, notably, that if doctors \u201cact in good faith and in the interests of patients, you\u2019ll be able to explain and justify your decisions and actions\u201d.<\/p>\n<p>Yet, in reality, the GMC do not appear concerned with these doctors\u2019 justifications or motivations for their actions and instead seem fixated on whether their actions broke the law. I have already argued why this position is problematic in a <a href=\"https:\/\/www.bmj.com\/content\/387\/bmj.q1888\">\u2018head-to-head\u2019<\/a> with the GMC themselves.<\/p>\n<p>With the GMC positioned as an ethical compass, it is concerning that they appear to be overlooking their own commissioned research, and the wording within the standards they have produced themselves.<\/p>\n<p><em>Promoting and protecting public health<\/em><\/p>\n<p>Crucially, the GMC hold a duty to promote and protect public health, yet they themselves have been slow to act on the climate emergency; having been <a href=\"https:\/\/www.bmj.com\/content\/382\/bmj.p1956\">criticised<\/a> for failing to embed environmental sustainability more meaningfully into Good Medical Practice, and for being slow to <a href=\"https:\/\/www.climatehealthscorecard.com\/pilot\">divest<\/a> from fossil fuels. Most concernedly, their failure to truly appreciate the climate crisis as a health emergency, is clear by their painting of climate activists as basing their actions on <a href=\"https:\/\/www.gmc-uk.org\/news\/news-archive\/statement-following-the-outcome-of-dr-sarah-benn-tribunal\">\u2018personal opinion\u2019<\/a> rather than on evidenced-based facts.<\/p>\n<p>With climate breakdown <a href=\"https:\/\/www.stockholmresilience.org\/research\/planetary-boundaries.html\">looming<\/a> and rises in global temperatures <a href=\"https:\/\/www.bbc.co.uk\/news\/science-environment-35073297\">already surpassing<\/a> safe levels, the <a href=\"https:\/\/climatepromise.undp.org\/news-and-stories\/climate-crisis-health-crisis-heres-why\">health consequences<\/a> of this escalating crisis are clear to anyone who has been paying attention.<\/p>\n<p>Thankfully, Hart\u2019s case provides the GMC with an opportune moment to re-evaluate its position on the climate emergency along with its treatment of whistleblowing climate protesters.<\/p>\n<p>To suspend a practicing GP who cares so deeply about patient health that he is willing to risk his own personal and professional freedoms to sound the alarm on the grave threats to public health would help no one, whilst harming everyone.<\/p>\n<p>It would also demonstrate a profound failure by the GMC to meet its own primary duties which are in service to the patients it exists to protect.<\/p>\n<hr \/>\n<p><strong>Author:<\/strong> Rammina Yassaie<\/p>\n<p><strong>Affiliations:<\/strong> Medical Doctor and Senior Lecturer in Leadership, Sheffield Hallam University<\/p>\n<p><strong>Competing interests:<\/strong> None declared<!--TrendMD v2.4.8--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Rammina Yassaie.
