I provided a <span class=\"c0\"><a class=\"c7\" href=\"https:\/\/www.google.com\/url?q=https:\/\/plato.stanford.edu\/entries\/libertarianism\/&amp;sa=D&amp;ust=1501587674452000&amp;usg=AFQjCNErspbMbyY-FszwdpwJMHr_dARoyA\">libertarian<\/a><\/span>\u00a0justification for this position, one grounded in a person&#8217;s right to <span class=\"c1\">self-ownership<\/span><span class=\"c2\">. Individuals are the sole legitimate moral owners of the DNA inside their bodies, just as they are the sole legitimate owners of their eyes and kidneys.<\/span><\/p>\n<p class=\"c4\">Libertarian moral ownership entails that individuals have a special authority with regard to uses \u00a0of their body parts<span class=\"c0\"><a class=\"c7\" href=\"https:\/\/www.google.com\/url?q=https:\/\/mises.org\/library\/self-ownership-freedom-and-equality-ga-cohen&amp;sa=D&amp;ust=1501587674453000&amp;usg=AFQjCNEFGIYqWtZRy4YffRT35EeYuoylLg\">\u00a0irrespective of the benefits of such ownership, measured in terms of how they contribute to advance the autonomy or well being <\/a><\/span>of every person. The libertarian moral authority each person has over his\/her DNA arises simply from being the sole owners of certain DNA molecules that happen to be parts of one\u2019s body. If people have such libertarian rights to the DNA inside their bodies then they have libertarian rights to test it and analyse it, irrespective of the clinical or personal utility of doing so. \u00a0This makes my libertarian argument for the right to test one\u2019s DNA independent from already known (autonomy or utility-based arguments) for an alleged \u201cright to know\u201d. People have the right to use their genome in any way they please, as long as others are not harmed (more precisely: as long as other people\u2019s rights against harm are respected). I do not claim to have discovered anything new: a libertarian right to test has been <a href=\"https:\/\/www.thepetitionsite.com\/1\/mydna\/\">invoked informally (and arguably, implicitly), without\u00a0<span class=\"c0\">philosophical analysis<\/span><\/a><span class=\"c2\">.<\/span><\/p>\n<p class=\"c4\">My argument in that paper has elicited a <a href=\"http:\/\/jme.bmj.com\/content\/early\/2017\/08\/20\/medethics-2016-103778\">critical response by Wendy Bonython and Bruce Arnold<\/a>,\u00a0who claim that the alleged right is incoherent, because genetic information is shared between <span class=\"c1\">relatives<\/span>. <span class=\"c1\">Identical twins for instance share their germ-line DNA sequences.<\/span><span class=\"c2\">\u00a0Moreover they observe that irresponsible uses of personal genetic information can easily harm relatives. They think that these considerations undermine the very idea of a libertarian right to test.<\/span><\/p>\n<p><!--more--><\/p>\n<p class=\"c4\">In <a href=\"http:\/\/jme.bmj.com\/content\/early\/2017\/08\/28\/medethics-2017-104188\">my commentary to their response<\/a>, I defend the <span class=\"c1\">libertarian right to test<\/span>\u00a0against such criticism, introducing a distinction between having an exclusive right the DNA in my body and having a right to shared genetic information more abstractly conceived. This is analogous to the distinction between owning a book (and having a right to read the information it contains) and owning the copyright to the text in that book. Twins\u2019 rights are distinct and they do not logically conflict, because each twin has the sole authority to control the DNA in their respective body and the information coming from <span class=\"c5\">it<\/span>, <span class=\"c5\">not the information coming from the DNA of the other twin<\/span><span class=\"c2\">.<\/span><\/p>\n<p class=\"c4\">Of course relatives may have rights against specific uses of genetic information by their relatives. It is plausible that persons have rights to privacy, which may be violated by irresponsible uses of my rights. For example, I should not upload my entire sequence and post a link to it on my Facebook page, without asking my twin\u2019s consent. My libertarian right to my genetic information must be exercised within the limits set<span class=\"c1\">\u00a0<\/span>by my twin\u2019s (arguably) equally strong right of <span class=\"c1\">privacy. <\/span>The <span class=\"c1\">contour <\/span>of my libertarian right to test is determined by<span class=\"c1\">\u00a0other rights my genetic relatives have. <\/span>(Providing a coherent and uncontroversial account of rights to <span class=\"c1\">genetic privacy<\/span><span class=\"c2\">\u00a0is a distinct philosophical challenge.) <\/span><\/p>\n<p class=\"c4\">Does that mean that the libertarian right to test is an \u201cempty\u201d right? \u00a0No, because having a libertarian right to test <span class=\"c1\">shifts the burden of the proof<\/span>. Having a libertarian right to test means that, in the absence of such demonstrable conflicts of rights, individuals should be allowed to test, even if the test has no clinical or personal utility and testing fails to advance their autonomy in meaningful ways. Moreover, the libertarian right to test provides an independent justification, a distinct normative position, which is not affected by attempt to undermines the \u201cautonomy based\u201d argument for the right to test some liberals have <span class=\"c0\"><a class=\"c7\" href=\"https:\/\/www.google.com\/url?q=http:\/\/jme.bmj.com\/content\/early\/2014\/05\/05\/medethics-2014-102026&amp;sa=D&amp;ust=1501587674455000&amp;usg=AFQjCNESIckMG-BR_pTf8AFUXf8XM3YQ6Q\">defended<\/a><\/span><span class=\"c2\">.<\/span><\/p>\n<p><!--TrendMD v2.4.8--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Guest Post: Michele Loi Article: Direct to Consumer Genetic Testing and the Libertarian Right to Test Should individuals be permitted to access their own genetic data without the mediation of a medical professional?
