Earp (<a href=\"https:\/\/twitter.com\/briandavidearp?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Eauthor\">@briandavidearp<\/a>)<\/p>\n<p>*\u00a0<em>Please note: this piece was <a href=\"http:\/\/quillette.com\/2017\/08\/15\/female-genital-mutilation-health-benefits-problem-medicalizing-morality\/#comment-9158\">originally published<\/a> in Quillette Magazine.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.detroitnews.com\/story\/news\/local\/oakland-county\/2017\/06\/14\/fourth-person-charged-female-genital-mutilation\/102853062\/\">Four members<\/a>\u00a0of the\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Dawoodi_Bohra\">Dawoodi Bohra<\/a>\u00a0sect of Islam\u00a0living in Detroit, Michigan have recently been indicted\u00a0on charges of female genital mutilation (FGM).\u00a0This is the <a href=\"https:\/\/www.washingtonpost.com\/national\/first-federal-case-under-female-genital-mutilation-ban-spurs-efforts-to-stiffen-penalties\/2017\/05\/25\/5b29d0de-39a9-11e7-a058-ddbb23c75d82_story.html?utm_term=.46fa0658d78f\">first time<\/a> the US government has prosecuted an \u201cFGM\u201d case since a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/116\">federal law<\/a> was passed in 1996. The world is watching to see how the case turns out.<\/p>\n<p>A <em>lot <\/em>is at stake here. Multiculturalism, religious freedom, the limits of tolerance; the scope of children\u2019s\u2014and minority group\u2014rights; the credibility of scientific research; even the very <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2986449\">concept<\/a> of \u201charm.\u201d<\/p>\n<p>To see how these pieces fit together, I need to describe the alleged crime.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>The term \u201cFGM\u201d is <a href=\"https:\/\/philpapers.org\/rec\/EARFGM\">likely<\/a> to bring to mind the most severe forms of female genital cutting, such as clitoridectomy or infibulation (partial sewing up of the vaginal opening). But the World Health Organization (WHO) actually recognizes <a href=\"http:\/\/www.who.int\/reproductivehealth\/topics\/fgm\/overview\/en\/\">four<\/a> main categories of FGM, covering <a href=\"https:\/\/www.academia.edu\/10197867\/Between_moral_relativism_and_moral_hypocrisy_reframing_the_debate_on_FGM_\">dozens<\/a> of different procedures.<\/p>\n<p>One of the more \u201cminor\u201d forms is called a \u201critual nick.\u201d This practice, which I have argued <a href=\"https:\/\/www.researchgate.net\/publication\/285578712_In_defence_of_genital_autonomy_for_children\">elsewhere<\/a> should not be performed on children, involves pricking the foreskin or \u201chood\u201d of the clitoris to release a drop of blood.<\/p>\n<p>Healthy tissue is not typically removed by this procedure, which is often done by <a href=\"http:\/\/ispub.com\/IJTWM\/9\/1\/5621\">trained clinicians<\/a> in the communities where it is common. Long-term adverse health consequences are <a href=\"http:\/\/jme.bmj.com\/content\/early\/2016\/02\/21\/medethics-2014-102375\">believed<\/a> to be rare.<\/p>\n<p>Here is why this matters. Initial, albeit <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation-now\/2017\/08\/10\/genital-cutting-defense-demands-photo-proof\/555023001\/\">conflicting <\/a>reports suggest that the Dawoodi Bohra engage in this, or a <a href=\"http:\/\/www.motherjones.com\/politics\/2017\/04\/genital-cutting-indian-doctor-women-khatna\/\">similar<\/a>, more limited form of female genital cutting \u2013 not the more extreme forms that are often <a href=\"https:\/\/www.sfog.se\/media\/295486\/omskarelse_rapport.pdf\">highlighted<\/a> in the Western media. This fact alone will make things rather complicated for the prosecution.<\/p>\n<p>The defense team has already <a href=\"http:\/\/www.freep.com\/story\/news\/2017\/05\/21\/female-genital-mutilation-religious-freedom\/319911001\/\">signaled<\/a> that it will emphasize the \u201clow-risk\u201d aspect of the alleged cutting, claiming that it shouldn&#8217;t really count as mutilation. It is, after all, far less invasive than Jewish ritual <a href=\"http:\/\/www.cirp.org\/library\/anatomy\/taylor\/\">male circumcision<\/a>, which is legally allowed on minors in the US, no questions asked.<\/p>\n<p>Based on this discrepancy, if attorneys for the Bohra can show a gendered or religious <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">double standard<\/a> in existing law, the ramifications will be not be small. Either male circumcision will have to be restricted in some way, or \u201c<a href=\"https:\/\/blogs.bmj.com\/medical-ethics\/2016\/02\/25\/should-doctors-perform-minor-forms-of-female-genital-mutilation-fgm-as-a-compromise-procedure-to-respect-culture\/\">minor<\/a>\u201d forms of <a href=\"https:\/\/www.researchgate.net\/publication\/285578712_In_defence_of_genital_autonomy_for_children\">FGM permitted<\/a>. The outcome either way will be explosive.<\/p>\n<p>I will dig into the male-female <a href=\"https:\/\/www.dovepress.com\/female-genital-mutilation-and-male-circumcision-toward-an-autonomy-bas-peer-reviewed-article-MB\">comparison<\/a>\u2014and explore its legal <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">implications<\/a>\u2014later on. But the law will not actually be my main focus. Instead, what I\u2019ll suggest in this piece is that the question of health consequences, whether positive or negative, should not exhaust the <em>ethical <\/em>analysis of these procedures.<\/p>\n<p>There is more to \u201cgood\u201d and \u201cbad\u201d than healthy versus unhealthy.<\/p>\n<p>In fact, as the Bohra case will show, there are serious, even dangerous <a href=\"http:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/nyuls5&amp;div=12&amp;id=&amp;page=\">downsides<\/a>\u00a0to\u00a0medicalizing moral reasoning \u2013 and to <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1525\/maq.2003.17.3.394\/abstract\">moralizing<\/a> medical research. On both counts, I argue, at least when it comes to childhood genital cutting, apparently <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/j.1548-1360.2012.01174.x\/abstract\">biased<\/a> <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/25646671\">policies<\/a> from the WHO are making things a great deal worse.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>\u201cThe tendency today is to roll over and \u2018scientify\u2019 everything,\u201d <a href=\"https:\/\/pdfs.semanticscholar.org\/dcf0\/1895d9ea02fa40752f25cc9f122a2d4e6b01.pdf\">says<\/a> Julian Savulescu, a philosopher at the University of Oxford. He goes on: \u201cEvidence will tell us what to do, people believe.\u201d But people are getting it wrong. When you reduce your ethical analysis to benefit-risk ratios, you miss important <a href=\"http:\/\/pennjil.com\/brian-earp-robert-darby-circumcision-sexual-experience-and-harm-reply-to-stephen-r-munzers-secularization-anti-minority-sentiment-and-cultural-norms-in-the-german-circumcision-cont\/\">questions of value<\/a>.<\/p>\n<p><!--more-->Take the ritual nick, or male circumcision for that matter, and ask yourself what might be morally problematic about these customs, benefits and risks to one side. A few possibilities come to mind.<\/p>\n<p>First, the perceived need to cut children\u2019s genitals\u2014whatever their sex or gender, and however severe the cutting\u2014as a precondition for accepting them into a community should plausibly be <a href=\"http:\/\/www.cirp.org\/library\/cultural\/goodman1999\/\">questioned<\/a>, rather than taken for granted.<\/p>\n<p>Part of the reason for this is that, regardless of health consequences, many individuals whose genitals were cut when they were children grow up to feel <a href=\"https:\/\/www.researchgate.net\/publication\/316527677_Gender_and_genital_cutting_A_new_paradigm?_iepl%5BviewId%5D=33IzCjIZRUGs6OInz7gcREK1&amp;_iepl%5BprofilePublicationItemVariant%5D=default&amp;_iepl%5Bcontexts%5D%5B0%5D=prfpi&amp;_iepl%5BtargetEntityId%5D=PB%25\">disturbed<\/a>\u00a0by what they take to be an <a href=\"http:\/\/www.motherjones.com\/politics\/2017\/04\/genital-cutting-indian-doctor-women-khatna\/\">intimate violation<\/a> carried out when they were too young to understand or refuse.<\/p>\n<p>That prospect alone should weigh heavily in parents\u2019 minds when contemplating these sorts of practices. The genitals are <a href=\"http:\/\/www.arclaw.org\/sites\/default\/files\/earp.pdf\">not like other parts of the body<\/a>. People assign different meanings to having their \u201cprivate parts\u201d cut or altered, and they do not always appreciate, much less value or endorse, the intentions of the ones who did the cutting.<\/p>\n<p>For example, realizing that they needed to be \u201cmarked\u201d or \u201cpurified\u201d\u2014that they were not seen as perfect the way they were born\u2014can be hard to swallow for many \u201ccut\u201d individuals, even if no tissue is removed. A person can always undergo a genital procedure later on in life, if that is what they want. But those who resent being cut <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2986449\">cannot \u201cundo\u201d what has happened<\/a>.<\/p>\n<p>There is also the possibility of\u00a0<a href=\"http:\/\/ajp.psychiatryonline.org\/doi\/abs\/10.1176\/appi.ajp.162.5.1000\">psychological<\/a>\u00a0harm, over and above the issue of contested \u201cmeanings.\u201d Although it is hard to measure scientifically, such harm <a href=\"http:\/\/journals.sagepub.com\/doi\/abs\/10.1177\/135910530200700310\">undoubtedly varies<\/a>\u00a0with the mental and emotional disposition of the child and the timing and circumstances of the cutting.<\/p>\n<p>Some Bohra women, for example, <a href=\"http:\/\/www.motherjones.com\/politics\/2017\/04\/genital-cutting-indian-doctor-women-khatna\/\">report<\/a> feeling emotionally traumatized by what happened to them when they were little girls\u2014the confusion, the pain, the embarrassment of being held down with their genitals exposed\u2014while <a href=\"https:\/\/dbwrf.org\/DB\/about\">others insist<\/a> that they didn\u2019t mind, and are proud of being cut. (Similar <a href=\"http:\/\/www.haaretz.com\/israel-news\/even-in-israel-more-and-more-parents-choose-not-to-circumcise-their-sons-1.436421\">ambivalence<\/a> can be found among religiously circumcised men.)<\/p>\n<p>Both kinds of <a href=\"http:\/\/www.girleffect.org\/what-girls-need\/articles\/2015\/02\/the-invisible-scars-of-fgm\/\">testimony<\/a> should be taken seriously. Yet those who claim there is no harm in \u201cmild\u201d forms of childhood genital cutting often ignore such individual differences. Instead, they point to vague, impersonal averages or talk in abstract, theoretical terms.<\/p>\n<p>Not uncommonly, they claim to be speaking on behalf of their <a href=\"http:\/\/blog.practicalethics.ox.ac.uk\/2012\/06\/religion-is-no-excuse-for-mutilating-your-babys-penis\/\">entire<\/a> religious community, as though it were a monolith (at least with respect to attitudes about cutting). Meanwhile, <a href=\"https:\/\/mobile.nytimes.com\/2017\/07\/25\/well\/family\/cutting-out-the-bris.html\">dissenters<\/a> from <a href=\"http:\/\/www.hindustantimes.com\/mumbai-news\/female-genital-mutilation-debate-puts-bohra-women-on-opposite-sides\/story-jx9r4R6CXFqFMIgsWDBASO.html\">within<\/a> the community are often <a href=\"http:\/\/www.slate.com\/articles\/health_and_science\/medical_examiner\/2013\/09\/intactivists_online_a_fringe_group_turned_the_internet_against_circumcision.html\">ridiculed<\/a>, waived away, or simply silenced: those who <a href=\"http:\/\/www.motherjones.com\/politics\/2017\/04\/genital-cutting-indian-doctor-women-khatna\/\">speak out<\/a> may be faced with \u201cexcommunication and <a href=\"http:\/\/timesofindia.indiatimes.com\/city\/hyderabad\/Social-boycott-the-sad-reality-for-reformist-Bohras\/articleshow\/50147331.cms\">social boycott<\/a>.\u201d<\/p>\n<p>The power of tradition to smother resistance can be intense.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>All of that said, even if \u201chealth consequences\u201d\u00a0<em>were<\/em>\u00a0the only thing that mattered morally, the fact that a given act of cutting is less severe than some alternative does not eliminate the need for concern. This is because any time a sharp object is brought into contact with sensitive flesh, it poses\u00a0<a href=\"https:\/\/www.researchgate.net\/publication\/285578712_In_defence_of_genital_autonomy_for_children?_iepl%5BviewId%5D=tzvBwACIvp4svD7rYEE9QNgs&amp;_iepl%5BprofilePublicationItemVariant%5D=default&amp;_iepl%5Bcontexts%5D%5B0%5D=prfpi&amp;_iepl%5BtargetEntityId%5D=P\">some risk<\/a>\u00a0of physical harm, however small.<\/p>\n<p>The knife could slip. Nerve damage could occur. Bleeding or infections could ensue. And while those factors might not be ethically decisive for more \u201cneutral\u201d parts of the body\u2014even ear-piercing and cosmetic orthodontics <a href=\"http:\/\/blog.practicalethics.ox.ac.uk\/2012\/08\/the-aap-report-on-circumcision-bad-science-bad-ethics-bad-medicine\/\">carry risks<\/a>\u2014a person might\u00a0<a href=\"https:\/\/www.researchgate.net\/publication\/315763686_Circumcision_sexual_experience_and_harm\">reasonably conclude<\/a>\u00a0that\u00a0<em>any<\/em>\u00a0chance of adverse outcomes is too great when it comes to their\u00a0<a href=\"http:\/\/www.arclaw.org\/sites\/default\/files\/earp.pdf\">sexual organs<\/a>.<\/p>\n<p>Finally, if health consequences in the form of \u201chealth benefits\u201d are seen as\u00a0<em>legitimizing<\/em>\u00a0childhood genital cutting\u2014as is\u00a0<a href=\"https:\/\/www.researchgate.net\/publication\/269899744_Does_science_support_infant_circumcision\">often suggested<\/a> in the case of male circumcision\u2014then <a href=\"https:\/\/dbwrf.org\/\">proponents<\/a> of female genital cutting (FGC) who are loath to give up their valued custom might be motivated to find such benefits in order to appease their critics.<\/p>\n<p>They might even succeed in doing so. For reasons I will get into later, it is not actually implausible that certain \u201cmild\u201d forms of FGC, such as neonatal labiaplasty, could\u00a0reduce the risk\u00a0of various diseases.<\/p>\n<p>But that wouldn\u2019t make the cutting a good idea. Instead, I will argue that children should be free to grow up with their genitals intact\u2014no nicks, cuts, or removal of tissue\u2014<em>even if\u00a0<\/em>the risk of adverse health consequences turns out to be mild, and\u00a0<em>even if<\/em>\u00a0certain health benefits can be found.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>What about the legal issues? I can\u2019t say too much about the particulars of the forthcoming trial because I don\u2019t want to prejudice the outcome, but I can make some general observations.<\/p>\n<p>To be frank, the US government has probably picked the worst possible case to show it is \u201cserious\u201d about addressing FGM. It is setting itself up for plausible accusations of anti-Muslim bias, as well as sexist <a href=\"http:\/\/www.cirp.org\/library\/legal\/davis1\/\">double standards<\/a> (as I hinted at before).<\/p>\n<p>The main reason for this is as follows. If convicted, the Muslim minority defendants face <a href=\"http:\/\/www.freep.com\/story\/news\/health\/2017\/04\/13\/feds-metro-detroit-girls-may-have-been-mutilated-too\/100434608\/\">10 years to life in prison<\/a> for allegedly practicing a form of FGM that is less physically invasive than other forms of medically unnecessary genital cutting that are <a href=\"http:\/\/www.corteidh.or.cr\/tablas\/r30541.pdf\">legally tolerated<\/a> in Western countries.<\/p>\n<p>I have already mentioned male <a href=\"https:\/\/www.dovepress.com\/female-genital-mutilation-and-male-circumcision-toward-an-autonomy-bas-peer-reviewed-article-MB\">circumcision<\/a>. There is also <a href=\"https:\/\/www.hrw.org\/news\/2017\/07\/25\/us-harmful-surgery-intersex-children\">intersex<\/a> genital \u201cnormalization\u201d surgery (which has been <a href=\"http:\/\/www.law.harvard.edu\/\">brilliantly discussed<\/a> in this context by Nancy Ehrenreich); supposedly virginity-signaling hymen \u201crepair\u201d surgeries (which I have written about <a href=\"http:\/\/jme.bmj.com\/content\/40\/6\/431\">elsewhere<\/a>); and at least some so-called \u201ccosmetic\u201d female genital <a href=\"https:\/\/www.researchgate.net\/publication\/221777048_Should_female_genital_cosmetic_surgery_and_genital_piercing_be_regarded_ethically_and_legally_as_female_genital_mutilation\">operations<\/a>, which are increasingly being carried out on <a href=\"http:\/\/bmjopen.bmj.com\/content\/2\/6\/e001908.full\">minors<\/a>.<\/p>\n<p>I promised I would tackle the male-female comparison, so let\u2019s look at male circumcision (some details are needed to spotlight the inconsistencies, but I hope you will bear with me). Unlike the \u201critual nick,\u201d which does not typically alter the form or function the external (female) genitalia, male circumcision permanently alters both.<\/p>\n<p>To begin with, it\u2014by definition\u2014removes most or all of <a href=\"http:\/\/www.cirp.org\/library\/anatomy\/taylor\/\">the foreskin<\/a>, which is about <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/9734426\">50 square centimeters<\/a> of elastic tissue in the adult organ and the <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1002\/tre.531\/abstract\">most sensitive<\/a> part of the penis to light touch.<\/p>\n<p>It creates a ring of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Circumcision_scar\">scar tissue<\/a> around the shaft that is often <a href=\"http:\/\/www.livestrong.com\/article\/275562-how-to-cover-up-a-circumcision-scar\/\">discolored<\/a>.<\/p>\n<p>It makes <a href=\"http:\/\/eknygos.lsmuni.lt\/springer\/59\/177-188.pdf\">sexual activities<\/a> that involve <a href=\"http:\/\/journals.sagepub.com\/doi\/abs\/10.1177\/1363460702005003003\">manipulation<\/a> of the foreskin\u2014see here for a NSFW <a href=\"http:\/\/www.circumstitions.com\/completeman\/sidegif.gif\">video<\/a>\u2014impossible. And it exposes the head of the penis, naturally an internal organ, to rubbing against clothing, which can cause chafing and irritation.<\/p>\n<p>Those are the guaranteed effects. Possible \u201cside effects\u201d <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC3253617\/\">include<\/a> painful erections if too much skin is removed (the penis is very small at birth and the choice of where to cut is essentially a guess), partial amputation of the glans due to surgical error, infections, cysts, fistulas, adhesions, pathological <a href=\"http:\/\/www.sciencedirect.com\/science\/article\/pii\/S1479666X16301792\">narrowing<\/a> of the urinary opening, severe blood loss, and rarely\u2014except in <a href=\"http:\/\/ulwaluko.co.za\/\">tribal settings<\/a> where it is common\u2014<a href=\"http:\/\/www.cbsnews.com\/news\/in-south-africa-circumcision-ritual-becomes-health-crisis\/\">death<\/a>.<\/p>\n<p>Yet it is perfectly legal in the United States to perform a circumcision on a male child for any reason. Religion, culture, parental preference\u2014regardless of the motivation, the cutting is tolerated, and you don\u2019t need a medical license to do it.<\/p>\n<p>In fact, even ultra-Orthodox Jews who perform an unhygienic \u201c<a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=14&amp;ved=0ahUKEwjljM_U8JvVAhUL_WMKHVP8CyYQFgh2MA0&amp;url=http%3A%2F%2Fjewishweek.timesofisrael.com%2Ftime-for-orthodox-jews-to-decry-metzitzah-bpeh%2F&amp;usg=AFQjCNE7_5O_gTt9GgJBVXbSlMB9PG83BQ\">oral suction<\/a>\u201d form of circumcision, in which the circumciser takes the boy\u2019s penis into his mouth and sucks the wound to staunch the bleeding, are <a href=\"http:\/\/www.thedailybeast.com\/ban-the-ritual-that-can-kill-jewish-newborns\">legally permitted<\/a> to do so without state <a href=\"http:\/\/jme.bmj.com\/content\/39\/7\/456\">certification<\/a> or oversight. This is despite confirmation of more than a dozen cases of herpes transmission, two cases of permanent brain damage, and two infant deaths <a href=\"https:\/\/www.cdc.gov\/mmwr\/preview\/mmwrhtml\/mm6122a2.htm?s_cid=mm6122a2_e\">likely caused<\/a> by the practice between 2004 and 2012.<\/p>\n<p>Those are just the figures for New York City. But still there are no legal restrictions. As the bioethicist Dena Davis has <a href=\"https:\/\/muse.jhu.edu\/article\/44126\/summary\">pointed out<\/a>, \u201cstates currently regulate the hygienic practices of those who cut our hair and our fingernails, so why not a baby&#8217;s genitals?\u201d<\/p>\n<p>She means \u201cbaby boy\u2019s\u201d genitals; baby girls\u2019 genitals are protected by law.<\/p>\n<p>The Bohra defense team will likely flag these inconsistencies. If ritual male circumcision is not only legally permitted but completely unregulated in the US, they will argue, then how can a procedure that carries fewer risks and is less physically damaging be classified as a federal crime? They will also point to the <a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2017\/05\/23\/religious-exemptions-and-the-detroit-female-genital-mutilation-prosecution\/?utm_term=.22f67e3b71c7\">religious significance<\/a> of \u201cfemale circumcision\u201d among the Bohra. They will ask: aren\u2019t religious practices granted strong legal protections in the United States and other Western countries?<\/p>\n<p>The prosecution will almost certainly make two moves in response. First, they will argue that FGM is not truly a religious practice, but is \u201cmerely\u201d a cultural tradition, because there is no mention of female circumcision in the Koran. And second, they will point out that male circumcision has been linked to certain health benefits, whereas FGM \u201chas no health benefits\u201d (as <a href=\"http:\/\/who.int\/reproductivehealth\/topics\/fgm\/en\/\">stated<\/a> by the WHO).<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>But things are not so simple. It is true that female circumcision is not mentioned in the Koran; but neither is male circumcision. And yet the latter is widely regarded as a \u201creligious\u201d practice not only within Judaism but also Islam. As Alex Myers <a href=\"http:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/15265161.2014.990166?journalCode=uajb20\">notes<\/a>, \u201cif we defer to religious justifications, we shall find that in many cases, the circumcision of female as well as male children could be permitted on this basis.\u201d<\/p>\n<p>How could that be so? In her landmark paper entitled, \u201c<a href=\"http:\/\/www.cirp.org\/library\/legal\/davis1\/\">Male and Female Genital Alteration: A Collision Course with the Law<\/a>,\u201d Dena Davis <a href=\"http:\/\/www.cirp.org\/library\/legal\/davis1\/\">notes<\/a> that \u201cbinding religious obligations\u201d can stem from oral traditions and other \u201cextrabiblical sources,\u201d such as rabbinic commentaries or papal encyclicals in the case of Judaism or Christianity. Likewise, \u201cIslam looks to other sources to interpret and supplement Koranic teachings.\u201d<\/p>\n<p>One such source is the Hadith\u2014the sayings of the Prophet Mohammed\u2014which is the other major basis for Islamic law apart from the Koran.<\/p>\n<p>Both male and female circumcision\u00a0<a href=\"http:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/twls1994&amp;div=9&amp;id=&amp;page=\">are mentioned in the Hadith<\/a>. Based on their reading of the relevant passages, some\u00a0<a href=\"https:\/\/islamqa.info\/en\/60314\">Muslim authorities<\/a>\u00a0state that \u201ccircumcision\u201d of both sexes is recommended or even obligatory, while others draw a\u00a0<a href=\"http:\/\/theislamicmonthly.com\/a-tiny-cut-female-circumcision-in-south-east-asia\/\">different conclusion<\/a>. There is no ultimate authority in Islam to settle such disputes, however, so debate continues to this day.<\/p>\n<p>What this means is that, until a consensus is reached in the Muslim world, the status of female genital cutting as a \u201creligious\u201d or \u201ccultural\u201d practice <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">will depend<\/a> on each community\u2019s local evaluation of secondary Islamic scriptures. Dawoodi Bohra clerics view the practice as <a href=\"http:\/\/www.independent.co.uk\/news\/world\/americas\/female-genital-mutilation-religious-right-us-first-case-fgm-detriot-michigan-a7748736.html\">religious<\/a>.<\/p>\n<p>This leads to an uncomfortable thought. In the West, we seem more or less unfazed by the religiously sanctioned cutting of boys\u2019 genitals; but we <a href=\"http:\/\/mobile.wnd.com\/2017\/07\/horror-hollywood-starlet-pleads-for-ban-on-mutilation-of-girls\/\">go into a panic<\/a> over less severe procedures performed on the genitals of girls by equally pious parents.<\/p>\n<p>In fact, we bend over backwards to convince ourselves that the latter procedures are \u201c<a href=\"http:\/\/www.dofeve.org\/religion-and-fgm.html\">not actually religious<\/a>\u201d by selectively citing scholars who agree with us\u2014as though not being \u201creligious\u201d somehow made a practice <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">less worthy<\/a> of being respected, or <em>being<\/em> \u201creligious\u201d made it <a href=\"https:\/\/www.academia.edu\/2589570\/Criticising_religious_practices\">morally OK<\/a>. Neither of those propositions follow.<\/p>\n<p>Finally, we attribute evil motives to the parents who circumcise their daughters, when the same parents <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1002\/hast.81\/abstract\">almost invariably<\/a> also circumcise their sons, sometimes more invasively, and often for <a href=\"http:\/\/www.dovepress.com\/\">identical reasons<\/a>. (The stereotype that female circumcision is \u201call about\u201d misogyny and sexual control, while male circumcision is about neither, is one that I, and <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1002\/hast.81\/full\">many other scholars<\/a>, <a href=\"https:\/\/www.researchgate.net\/publication\/280080464_Between_moral_relativism_and_moral_hypocrisy_Reframing_the_debate_on_FGM\">have<\/a> <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">deconstructed<\/a> <a href=\"https:\/\/www.dovepress.com\/female-genital-mutilation-and-male-circumcision-toward-an-autonomy-bas-peer-reviewed-article-MB\">elsewhere<\/a>: see <a href=\"http:\/\/euromind.global\/en\/brian-d-earp-and-rebecca-steinfeld\/\">here<\/a> for a fairly short summary. Suffice it to say the claim is not true.)<\/p>\n<p>So who are we kidding? The overwhelming majority of <a href=\"http:\/\/www.cirp.org\/library\/general\/wallerstein\/\">American parents<\/a> who circumcise their sons do it for \u201ccultural\u201d rather than religious reasons, and few seem concerned to bat an eye. Even many Jews who circumcise are committed <a href=\"http:\/\/www.pewforum.org\/2013\/10\/01\/jewish-american-beliefs-attitudes-culture-survey\/\">atheists<\/a> (and for all I know, <a href=\"https:\/\/en.wikipedia.org\/wiki\/List_of_former_Muslims#Became_atheists\">so are<\/a> many Muslims). Although the law may treat \u201creligion\u201d as a special, separate category, the religious versus \u201ccultural\u201d status of male or female genital cutting is <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">not what drives<\/a> our different moral judgments.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>So maybe it\u2019s \u201chealth benefits.\u201d Maybe we think male circumcision is acceptable because it has medical advantages, whereas female circumcision only has \u201csocial\u201d advantages (eligibility for marriage, greater acceptance by the community, <a href=\"https:\/\/humdev.uchicago.edu\/sites\/humdev.uchicago.edu\/files\/uploads\/shweder\/Disputing%20The%20Myth%20of%20the%20sexual%20dysfunction%20of%20cicumcised%20women.pdf\">seen as more aesthetic<\/a>, and so on).<\/p>\n<p>I don\u2019t think that\u2019s the solution, either. First, the idea that \u201csocial\u201d benefits are less important than \u201chealth\u201d benefits would need some defending: I have already mentioned the pitfalls of capitulating to the domain of medicine <a href=\"http:\/\/jme.bmj.com\/content\/41\/1\/28\">in order to avoid<\/a> having to think through complex moral issues. But let us just assume that all we care about is \u201chealth\u201d for a moment and see where this exercise leads us.<\/p>\n<p>Most of the decent-quality data showing health benefits for male circumcision (primarily, a modest reduction in the absolute risk of some sexually transmitted infections) come from surgeries performed on adults in Africa, <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1111\/jsm.12703\/abstract\">not babies<\/a> in the United States or Europe. The findings <a href=\"http:\/\/www.tandfonline.com\/doi\/full\/10.1080\/17441692.2016.1184292\">cannot<\/a> be simply copy-pasted from one context and age range to another.<\/p>\n<p>But even if you could just copy and paste, you would still have to factor in the <a href=\"https:\/\/kiej.georgetown.edu\/wordpress\/wp-content\/uploads\/2015\/03\/03_25.1darby.pdf\">risks and harms<\/a> of circumcision, which are not trivial. In fact, most national medical associations to have issued formal policies on the question have found that the benefits of childhood male circumcision are <a href=\"http:\/\/pediatrics.aappublications.org\/content\/early\/2013\/03\/12\/peds.2012-2896\">not sufficient<\/a> to outweigh the disadvantages of the surgery in developed countries.<\/p>\n<p>(There is one glaring exception to this, which we\u2019ll come back to.)<\/p>\n<p>This suggests either that the scales are closely balanced, as the Canadian Pediatric Society <a href=\"http:\/\/www.cps.ca\/documents\/position\/circumcision\">claims<\/a>, or actually tipped in the direction of net harm, as the Royal Dutch Medical Association <a href=\"http:\/\/www.circumstitions.com\/Docs\/KNMG-policy.pdf\">has concluded<\/a>. Further south, the Royal Australasian College of Physicians <a href=\"https:\/\/www.racp.edu.au\/docs\/default-source\/advocacy-library\/circumcision-of-infant-males.pdf\">states:<\/a> \u201cthe level of protection offered by circumcision and the complication rates of circumcision do not warrant routine infant circumcision in Australia and New Zealand.\u201d<\/p>\n<p>In any case, the existence of \u201csome\u201d health benefits (as opposed to <em>net<\/em> health benefits\u2014and that would still not resolve the moral issues) would make for a very weak defense of the practice even on purely medical grounds.<\/p>\n<p>Just think. Removing any healthy tissue from a child\u2019s body will confer \u201csome\u201d health benefits: tissue that has been excised can no longer host a cancer, become infected, or pose any other problem to its erstwhile owner. But as the bioethicist Eike-Henner Kluge has <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC1336952\/\">noted<\/a>, if this logic were accepted more generally, \u201call sorts of medical conditions would be implicated\u201d and we would find ourselves \u201coperating non-stop on just about every part of the human body.\u201d<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>Alarmingly, one place we might start operating is the pediatric vulva. Compared to the penis, the external female genitalia <a href=\"https:\/\/www.researchgate.net\/publication\/316505694_Reason_and_paradox_in_medical_and_family_law_Shaping_children%27s_bodies\">provide if anything<\/a> \u201can even more hospitable environment to bacteria, yeasts, viruses, and so forth, such that removing moist folds of tissue (with a sterile surgical instrument) might very well reduce the risk of associated problems.\u201d<\/p>\n<p>In countries where female circumcision is relatively common, this is exactly what is <a href=\"https:\/\/islamqa.info\/en\/45528\">claimed<\/a> for the procedure. Cited health benefits <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1525\/maq.2007.21.3.301\/abstract\">include<\/a> \u201ca lower risk of vaginal cancer &#8230; fewer infections from microbes gathering under the hood of the clitoris, and protection against herpes and genital ulcers.\u201d<\/p>\n<p>Moreover, at least <a href=\"http:\/\/scholarworks.gsu.edu\/cgi\/viewcontent.cgi?article=1113&amp;context=iph_theses\">two studies<\/a> by Western scientists <a href=\"https:\/\/www.researchgate.net\/publication\/265824402_Female_Circumcision_and_HIV_Infection_in_Tanzania_for_Better_or_for_Worse\">have shown<\/a> a negative correlation between female circumcision and HIV. The authors of one of the studies, both seasoned statisticians who expected to find the opposite relationship, described their findings as a \u201csignificant and perplexing inverse association between reported female circumcision and HIV seropositivity.\u201d<\/p>\n<p>None of these findings is conclusive. I am <em>not<\/em> saying that female \u201ccircumcision\u201d can ward off HIV or any other disease. But let us just imagine that some of the above-cited health benefits are eventually confirmed. Would anti-FGM campaigners suddenly be prepared to say that female genital cutting was ethically acceptable?<\/p>\n<p>I would be surprised if that turned out to be the case. In other words, even if health benefits do one day become reliably associated with some medicalized form of female genital cutting, I expect that opponents of the practice\u2014including the WHO\u2014would say, \u201cSo what?\u201d<\/p>\n<p>First, they would argue that healthy tissue is valuable in-and-of-itself, so should be counted in the \u201charm\u201d column simply by virtue of being damaged or removed. Second, they would point to non-surgical means of preventing or treating infections, and suggest that these <a href=\"http:\/\/www.cirp.org\/library\/ethics\/hodges3\/\">should be favored<\/a> over more invasive methods. And third, they would bring up the language of rights: a girl has a right to grow up with her genitals intact, they would say, and decide for herself at an age of understanding whether she would like to have parts of them cut into or cut off.<\/p>\n<p>The same arguments apply to male circumcision. But as Kirsten Bell has <a href=\"http:\/\/www.cirp.org\/library\/anthropology\/bell1\/\">pointed out<\/a>, the WHO steadfastly refuses to connect the dots. In her words, they seek to \u201c<a href=\"https:\/\/open.library.ubc.ca\/cIRcle\/collections\/facultyresearchandpublications\/52383\/items\/1.0221481\">medicalize<\/a> male circumcision on the one hand\u201d by promoting it, over the objections and <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pubmed\/25646671\">reservations<\/a> of many <a href=\"https:\/\/link.springer.com\/chapter\/10.1007%2F978-90-481-9446-9_4\">outside experts<\/a>, as a form of prophylaxis against HIV. But they \u201coppose the medicalization of female circumcision on the other, while simultaneously basing their opposition to female operations on grounds that could legitimately be used to condemn the male operations.\u201d<\/p>\n<p>The problem with appeals to \u201chealth benefits,\u201d then, is that they are disingenuous and inconsistently applied. As Robert Darby <a href=\"https:\/\/muse.jhu.edu\/article\/627257\">has argued<\/a>, \u201cofficial bodies working against FGC have condemned medicalization of the procedure and funded massive research programs into the harm of the surgery.\u201d The irony, as he sees it, is that the WHO \u201calso frames male circumcision as a public health issue\u2014but from the opposite starting point.\u201d Thus, we see that<\/p>\n<blockquote><p>instead of a research program to study the possible harms of circumcision, it funds research into the benefits and advantages of the operation. In neither case, however, is the research open-ended: in relation to women the search is for damage, in relation to men it is for benefit; and since the initial assumptions influence the outcomes, these results are duly found.<\/p><\/blockquote>\n<p>Perhaps even more striking, the WHO\u2019s asymmetrical focus on health benefits could backfire. Specifically, it could open the door for supporters of female genital cutting to <a href=\"http:\/\/www.thesierraleonetelegraph.com\/?p=13572\">mount a defense of the procedure<\/a> modeled on the male parallel.<\/p>\n<p>To put it simply, if the sheer existence of health benefits is so compelling to organizations like WHO, these supporters might think, then all we have to do is generate the right kind of evidence, and we can fend off critics of our cherished custom.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>There are already signs of this happening. At least one female Muslim gynecologist\u2014from Khartoum University in the Sudan\u2014has been <a href=\"https:\/\/islamqa.info\/en\/45528\">reported<\/a> as saying: \u201cif the benefits [of female circumcision] are not apparent now, they will become known in the future, as has happened with regard to male circumcision.\u201d<\/p>\n<p>(Perhaps she will be inspired by the <a href=\"https:\/\/www.davidghozland.com\/benefits-labiaplasty\/\">websites<\/a> of American plastic surgeons, who already claim all manner of physical and mental health benefits for <a href=\"http:\/\/bmjopen.bmj.com\/content\/2\/6\/e001908.full\">elective labiaplasty<\/a> \u2013 and other purported \u201ccosmetic\u201d operations).<\/p>\n<p>Similarly, the anthropologist Fuambai Ahmadu has <a href=\"https:\/\/humdev.uchicago.edu\/sites\/humdev.uchicago.edu\/files\/uploads\/shweder\/Disputing%20The%20Myth%20of%20the%20sexual%20dysfunction%20of%20cicumcised%20women.pdf\">written about<\/a> the women of Sierra Leone: \u201cWhy, one woman asked, would any reasonable mother want to burden her daughter with excess clitoral and labial tissue that is unhygienic, unsightly and interferes with sexual penetration \u2026 especially if the same mother would choose circumcision to ensure healthy and aesthetically appealing genitalia for her son?\u201d<\/p>\n<p>And what about the Dawoodi Bohra? As <a href=\"http:\/\/www.motherjones.com\/politics\/2017\/04\/genital-cutting-indian-doctor-women-khatna\/\">reported<\/a> by Tasneem Raja, herself a member of the community and a former <a href=\"http:\/\/www.npr.org\/2017\/04\/24\/525441611\/writer-recalls-undergoing-female-genital-mutilation-in-the-u-s\">editor at NPR<\/a>, some Bohra women believe that female circumcision, which they call <em>khatna<\/em>, \u201chas something to do with \u2018removing bad germs\u2019 and liken it to male circumcision, which is widely \u2026 believed to have hygienic benefits.\u201d<\/p>\n<p>It is currently illegal in Western countries to conduct a properly controlled scientific study to determine whether a \u201cmild,\u201d sterilized form of female genital cutting carried out in infancy or early childhood confers some degree of protection against disease.<\/p>\n<p>But if anti-FGM campaigners and organizations such as the WHO continue to play the \u201cno health benefits\u201d card as a way of deflecting comparisons to male circumcision, it will not be long before <a href=\"http:\/\/umatia.org\/2011\/safecircumcision.html\">medically-trained supporters<\/a> of the practice in other countries begin to do the necessary research.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>The <a href=\"https:\/\/www.amazon.com\/Surgical-Temptation-Demonization-Foreskin-Circumcision\/dp\/0226136450\">history<\/a> of male circumcision shows how this could happen. Alongside female genital cutting, male genital cutting originated in African prehistory as a ritual practice, and was later adopted by various Semitic tribes. For most of its existence, the only claimed advantages of the procedure were social or metaphysical in nature\u2014identifying the boy as a member of a particular group, for example, or sealing a divine covenant, <a href=\"http:\/\/www.cirp.org\/pages\/cultural\/kimmel1\/\">as in Judaism<\/a>.<\/p>\n<p>In the physical realm, by contrast, circumcision was largely believed to have negative effects, including on <a href=\"http:\/\/onlinelibrary.wiley.com\/doi\/10.1002\/tre.531\/abstract\">sexual feeling<\/a> and satisfaction. By \u201cdulling\u201d the sexual organ of male children, parents believed that their sons would pay more attention to important \u201cspiritual\u201d matters and be <a href=\"http:\/\/www.cirp.org\/library\/cultural\/maimonides\/\">less tempted<\/a> by the pleasures of the flesh.<\/p>\n<p>It was only in recent times that religious supporters of male circumcision <a href=\"http:\/\/www.cirp.org\/library\/history\/gollaher\/\">began<\/a> to argue that it was \u201cphysically\u201d beneficial\u2014recasting the procedure as a <a href=\"https:\/\/www.smj.org.sa\/index.php\/smj\/article\/view\/smj.2017.2.18065\/10051\">secularly defensible<\/a> measure of individual or even public health, as opposed to solely a cultural or religious practice.<\/p>\n<p>In the United States, for example, circumcision was <a href=\"https:\/\/link.springer.com\/chapter\/10.1007%2F978-1-4757-2679-4_2\">adopted<\/a> in part as an anti-masturbation tactic in the late 1800s (masturbation, at the time, was thought to cause not only moral but medical ills; see <a href=\"https:\/\/www.google.com\/url?sa=t&amp;rct=j&amp;q=&amp;esrc=s&amp;source=web&amp;cd=1&amp;ved=0ahUKEwjGuYLbp87VAhWBfCYKHbMNB84QyCkIKjAA&amp;url=https%3A%2F%2Fwww.youtube.com%2Fwatch%3Fv%3DgCSWbTv3hng&amp;usg=AFQjCNE49cTYwPBNySW5XCRtLMBF0nBs2A\">here<\/a> for a video introduction). The resulting shift from \u201creligious\u201d to \u201cmedical\u201d proved <a href=\"https:\/\/networks.h-net.org\/node\/6056\/reviews\/7138\/wentzell-glick-marked-your-flesh-circumcision-ancient-judea-modern\">strategically important<\/a> in Christian-majority societies, where genital cutting of children had otherwise been seen as barbaric.<\/p>\n<p>The medical historian David Gollaher <a href=\"http:\/\/www.cirp.org\/library\/history\/gollaher\/\">has argued<\/a> that Jewish physicians, whose \u201cattitudes toward circumcision were partly shaped by their own cultural experience,\u201d found the late 19<sup>th<\/sup> century evidence of health benefits \u201cespecially compelling.\u201d Most of it was <a href=\"http:\/\/www.tandfonline.com\/doi\/abs\/10.1016\/S0968-8080(07)29303-6\">later debunked<\/a>.<\/p>\n<p>Nevertheless, the search for \u201chealth benefits\u201d continues to this day. A large proportion of the current medical literature purporting to show health benefits for male circumcision has been generated by doctors who were themselves circumcised at birth\u2014often for religious reasons\u2014and who have cultural, financial, or other <a href=\"https:\/\/www.researchgate.net\/publication\/316527603_Cultural_bias_in_American_medicine_The_case_of_infant_male_circumcision\">interests<\/a> in seeing the practice preserved.<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>Science and medicine are <a href=\"http:\/\/quillette.com\/2016\/02\/15\/the-unbearable-asymmetry-of-bullshit\/\">not immune<\/a> from such <a href=\"https:\/\/www.academia.edu\/6991840\/the_aMeriCan_aCadeMy_of_PediatriCs_and_feMale_genital_Cutting_When_national_organizations_are_guided_by_Personal_agendas\">agendas<\/a> or <a href=\"https:\/\/www.researchgate.net\/publication\/316527603_Cultural_bias_in_American_medicine_The_case_of_infant_male_circumcision\">biases<\/a>. In 2012, the American Academy of Pediatrics (AAP) controversially concluded that the health benefits of newborn male circumcision outweighed the risks (this is the \u201cglaring exception\u201d I said I\u2019d come back to). Their conclusion was puzzling, since they did not have a method for <a href=\"https:\/\/www.researchgate.net\/publication\/316527603_Cultural_bias_in_American_medicine_The_case_of_infant_male_circumcision\">assigning weights<\/a> to individual benefits or risks, much less an accepted mechanism by which the two could be compared.<\/p>\n<p>They were also missing the denominator to their equation. On page 772 of their <a href=\"http:\/\/pediatrics.aappublications.org\/content\/130\/3\/e756\">report<\/a> they state that, due to limitations with the existing data, \u201cthe true incidence of complications after newborn circumcision is unknown.\u201d<\/p>\n<p>So how could we know they are outweighed by the benefits?<\/p>\n<p>In an unprecedented move, the AAP was <a href=\"http:\/\/pediatrics.aappublications.org\/content\/early\/2013\/03\/12\/peds.2012-2896\">rebuked<\/a> by senior physicians, ethicists, and representatives from national medical societies based in the UK, Canada, and mainland Europe, who argued that the findings were likely <a href=\"https:\/\/www.researchgate.net\/publication\/316527603_Cultural_bias_in_American_medicine_The_case_of_infant_male_circumcision\">culturally biased<\/a>. The AAP Circumcision Task Force later <a href=\"http:\/\/jme.bmj.com\/content\/early\/2013\/03\/18\/medethics-2013-101456\">acknowledged<\/a> that the benefits were only \u201cfelt\u201d to outweigh the risks. It came down to a subjective judgment.<\/p>\n<p>Reflecting on the debacle in a recent editorial, Task Force member Andrew Freedman tried to <a href=\"http:\/\/pediatrics.aappublications.org\/content\/pediatrics\/early\/2016\/04\/04\/peds.2016-0594.full.pdf\">explain<\/a> how he and his colleagues had reached a different conclusion to that of their peers in other countries despite looking at the same medical evidence. In doing so, he made a revealing comment:<\/p>\n<blockquote><p>Most circumcisions are done due to religious and cultural tradition. In the West, although parents may use the conflicting medical literature to buttress their own beliefs and desires, for the most part parents choose what they want for a wide variety of nonmedical reasons. There can be no doubt that religion, culture, aesthetic preference, familial identity, and personal experience all factor into their decision.<\/p><\/blockquote>\n<p>In a separate <a href=\"http:\/\/jewishweek.timesofisrael.com\/fleshing-out-change-on-circumcision\/\">interview<\/a>, Freedman stated that he had circumcised his own son on his parents\u2019 kitchen table. \u201cBut I did it for religious, not medical reasons,\u201d he wrote. \u201cI did it because I had 3,000 years of ancestors looking over my shoulder.\u201d<\/p>\n<p>Arguing that it is \u201cnot illegitimate\u201d for parents to consider such social and spiritual \u201crealms [in] making this nontherapeutic, only partially medical decision,\u201d Freedman went on to say that \u201cprotecting\u201d the parental option to circumcise \u201cwas not an idle concern\u201d in the minds of the AAP Task Force members \u201cat a time when there are serious efforts in both the United States and Europe to ban the procedure outright.\u201d<\/p>\n<p style=\"text-align: center;\">* * *<\/p>\n<p>The women in societies that practice what they call female circumcision are just as <a href=\"http:\/\/www.truthdig.com\/report\/page3\/20090702_designer_vaginas_is_female_circumcision_coming_out_of_the_closet\">devoted<\/a> to their <a href=\"https:\/\/www.sfog.se\/media\/295486\/omskarelse_rapport.pdf\">cultural traditions<\/a> as are the men who practice genital cutting of boys. They don\u2019t want their customs banned either. If \u201cmedical benefits\u201d are sufficient to ward off condemnation, a strong incentive will exist to seek them out.<\/p>\n<p>I suggest, therefore, that by repeating the mantra\u2014in nearly every article focused on female genital cutting\u2014that \u201cFGM has no health benefits,\u201d those who oppose such cutting are sending the wrong signal. The mantra implies that if FGM <em>did<\/em> have health benefits, it wouldn\u2019t be so bad after all.<\/p>\n<p>But that isn\u2019t what opponents really think. <em>Regardless<\/em> of health consequences, they see nontherapeutic genital cutting of female minors as contrary to their best interests, propped up by questionable social norms that should themselves be challenged and changed.<\/p>\n<p>I would go one step further. <em>All<\/em> children\u2014female, male, and intersex\u2014have a <a href=\"http:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/23269995.2013.804757\">compelling interest<\/a> in intact genitalia. All else being equal, <em>they<\/em> should get to decide whether they want their \u201cprivate parts\u201d nicked, pricked, labiaplastied, \u201cnormalized,\u201d circumcised, or sewn, at an age when they can appreciate what is really at stake.<\/p>\n<p>This doesn\u2019t mean a \u201c<a href=\"http:\/\/jme.bmj.com\/content\/39\/7\/459\">ban<\/a>\u201d on such procedures before an age of consent is necessarily the best way to go. As I have explained <a href=\"http:\/\/blog.practicalethics.ox.ac.uk\/2014\/03\/things-ive-learned-so-far-about-how-to-do-practical-ethics\/\">elsewhere<\/a>, legal prohibition can be a clumsy way of bringing about social change, often causing more harm than good. I worry, for example, that taking young girls out of their homes, invasively examining their genitals in search of \u201cevidence,\u201d and throwing their parents\u2014who no doubt love them\u2014in jail, could be more traumatic than the initial act of cutting.<\/p>\n<p>As for the Dawoodi Bohra case, we will just have to see how the judge interprets\u2014and applies\u2014the existing laws.<\/p>\n<p>My own preference is for <a href=\"https:\/\/www.academia.edu\/5790352\/Assessing_a_religious_practice_from_secular-ethical_grounds_Competing_meta-ethics_in_the_circumcision_debate_and_a_note_about_respect\">debate and dialogue<\/a>, not bans and vilification. But whatever approach one takes, it is time to move beyond the tired (and false) dichotomies of male versus female, religion versus culture, and health benefits versus no health benefits.
