I require care around the clock and am in constant pain. I am 65; as I get older, I fear I may need help to die, an option currently prohibited by the Suicide Act in England and Wales, which I am campaigning to change.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Seven years ago the UK Supreme Court delivered a <\/span><a href=\"https:\/\/www.supremecourt.uk\/cases\/docs\/uksc-2013-0235-judgment.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">landmark judgment on assisted dying<\/span><\/a><span style=\"font-weight: 400\">, in which a majority of judges ruled it would be legitimate for the courts to rule on whether current law is compatible with human rights law. Yet rather than passing judgement immediately, they narrowly decided to give parliament an opportunity to debate the issue. I was one of the people who brought the case.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a clear verdict, our top court warned parliament not to waste the opportunity it had been given and invited me to bring a future case should our lawmakers fail to act. Parliament did not act, so in July 2019 I applied to court for permission to challenge the law again. But to my surprise the Court of Appeal <\/span><a href=\"https:\/\/humanism.org.uk\/2020\/11\/25\/paul-lambs-assisted-dying-case-refused-permission-by-court-of-appeal\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">refused me this permission<\/span><\/a><span style=\"font-weight: 400\">. Why has the court done this, and what does it mean for my fight for the right to die?<\/span><\/p>\n<p><span style=\"font-weight: 400\">As to the first question, the Court of Appeal gave me two explanations. First, it ruled that assisted dying was \u201cpre-eminently a matter for parliament and not the courts,\u201d seemingly reversing the decision of our Supreme Court seven years ago. And second, it said it could find \u201cno other compelling reason\u201d to hear my case.<\/span><\/p>\n<p><b>Compelling reasons to re-examine the law<\/b><\/p>\n<p><span style=\"font-weight: 400\">To say this judgement misses the point would be an understatement. In the past 15 years the number of Britons travelling abroad for assisted deaths has risen six-fold,<\/span>\u00a0<a href=\"https:\/\/humanism.org.uk\/wp-content\/uploads\/2019-2-1-KM-Assisted-Dying-Briefing_-Number-of-UK-citizens-going-to-Switzerland-to-seek-an-assisted-death-1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">to at least one per week<\/span><\/a><span style=\"font-weight: 400\">;<\/span><a href=\"https:\/\/humanism.org.uk\/2019\/03\/04\/public-support-for-assisted-dying-now-over-90-reveals-study\/\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400\">nine out of 10 members of the public have come to support legalising the right to die<\/span><\/a><span style=\"font-weight: 400\">, a right already available to 150 million people worldwide. And in the<\/span><a href=\"https:\/\/humanism.org.uk\/2020\/10\/08\/doctors-vote-to-end-assisted-dying-opposition-in-landmark-bma-survey\/\" target=\"_blank\" rel=\"noopener noreferrer\"> <span style=\"font-weight: 400\">BMA\u2019s recent survey, half of doctors who responded said they personally supported changing the law<\/span><\/a><span style=\"font-weight: 400\">. Alone any of these developments would be \u201ccompelling,\u201d but taken together they clearly show that the consensus on assisted dying has shifted and that the law warrants a re-examination.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It\u2019s important to be clear that my case didn\u2019t ask for any special privileges. Provided you are able bodied, nothing in law prevents you from choosing how, where, and when you want to end your life. After all, suicide isn\u2019t a crime. It is only for people like me, who are physically incapable of ending our lives without assistance, that the law denies a choice.\u00a0<\/span><\/p>\n<p><b>Uncertainty and fear for my future<\/b><\/p>\n<p><span style=\"font-weight: 400\">As to what this means for my future, the answer is uncertainty and fear. Following my case, it seems likely that litigation won\u2019t be possible for the foreseeable future. In other words, only parliament has the power to change my fate. Yet parliament has already proved itself more than capable of avoiding the tough questions on assisted dying: it has never considered legislation to permit the option of an assisted death for people who are incurably suffering but not terminally ill. And while our politicians might have time to wait, I don\u2019t have that luxury.<\/span><\/p>\n<p><span style=\"font-weight: 400\">After 30 years of paralysis I am finding my pain harder to manage and mitigate. Whereas previously, I sometimes felt like I had an itch I couldn\u2019t scratch; now it often feels as though someone has hit me over the back of my neck with a cricket bat.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This is why I want the choice of an assisted death. Not because I want to die tomorrow, but because I want the security of knowing I can end my pain if it ever becomes too much to bear. And because my only legal option\u2014starving myself to death\u2014fills me with terror.<\/span><\/p>\n<p><span style=\"font-weight: 400\">That\u2019s why, with support from the secularist charity Humanists UK,<\/span>\u00a0<a href=\"https:\/\/humanism.org.uk\/wp-content\/uploads\/Paul-Lamb-Letter-to-Robert-Buckland.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400\">I have written to the secretary of state for justice<\/span><\/a><span style=\"font-weight: 400\"> urging him to start an inquiry into the law or to call on parliament to do so.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a mature country like this, laws should be based on robust evidence and rational debate. It is an insult to people in my situation that more than 15 years have now passed since parliament last examined in detail the evidence on assisted dying, and six years since it voted on proposals to change the law. If our lawmakers truly are the only people now capable of giving me a choice over my own death, it is high time that they picked up the baton and undertook a detailed examination of the law.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This issue is too important to be relegated to the \u201ctoo hard to solve\u201d category.
