It is the government\u2019s urgent duty to answer them, say Martin McKee and Trish Greenhalgh<\/p>\n<p><!--more--><span style=\"font-weight: 400\">The imminent re-release of the 1949 movie <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/The_Third_Man\"><i><span style=\"font-weight: 400\">The Third Man<\/span><\/i><\/a><span style=\"font-weight: 400\"> has led the writer and broadcaster Danny Leigh to draw <\/span><a href=\"https:\/\/www.theguardian.com\/film\/2019\/sep\/05\/why-the-third-man-is-an-essential-primer-for-no-deal-brexit\"><span style=\"font-weight: 400\">parallels with Brexit<\/span><\/a><span style=\"font-weight: 400\">. Set in post-war Vienna beset by shortages of medicines, <\/span><i><span style=\"font-weight: 400\">The Third Man<\/span><\/i><span style=\"font-weight: 400\"> recounts the actions of the disaster capitalists of the day trading in counterfeit penicillin. The anti-hero, Harry Lime, looks down from a Ferris wheel at the people below and asks, \u201cWould you really feel any pity if one of those dots stopped moving?\u201d.\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Doctors, if their professional virtues were fully honed, would feel more than pity. They will feel compelled to act. The UK General Medical Council\u2019s guidance, <\/span><em><a href=\"https:\/\/www.gmc-uk.org\/ethical-guidance\/ethical-guidance-for-doctors\/good-medical-practice\/duties-of-a-doctor\"><span style=\"font-weight: 400\">Duties of a Doctor<\/span><\/a><\/em><span style=\"font-weight: 400\">, advises doctors to \u201cmake the care of your patient your first concern\u201d, \u201ctake prompt action if you think that patient safety \u2026 is being compromised\u201d and \u201cbe honest and open and act with integrity.\u201d\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">David Nicholl is a consultant neurologist specialising in the care of people with epilepsy\u2014one of several conditions which the UK government highlighted in its no-deal Brexit planning, codenamed <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Operation_Yellowhammer\"><span style=\"font-weight: 400\">Operation Yellowhammer<\/span><\/a><span style=\"font-weight: 400\">, when it predicted potential drug shortages. Nicholl had been involved in preparing advice to government, but unlike many of his colleagues, he had not signed any non-disclosure agreements.\u00a0 Knowing that patients with epilepsy are especially vulnerable to interruptions in supply of their medicines, he repeatedly voiced his concerns in the media.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In a <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=3a_ecUCq610&amp;feature=youtu.be\"><span style=\"font-weight: 400\">live radio phone-in<\/span><\/a><span style=\"font-weight: 400\"> on 2<\/span><span style=\"font-weight: 400\"> September, Nicholl challenged Conservative MP Jacob Rees-Mogg to be open about the threat to patients\u2019 health of a no-deal Brexit. Rees-Mogg responded by accusing him of fearmongering, adding that he could not see any reason why people might die. This was despite the <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Operation_Yellowhammer\"><span style=\"font-weight: 400\">Operation Yellowhammer<\/span><\/a><span style=\"font-weight: 400\"> report, along with more detailed analyses from <\/span><a href=\"https:\/\/www.bmj.com\/content\/366\/bmj.l5300.abstract\"><span style=\"font-weight: 400\">academic researchers<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.kingsfund.org.uk\/publications\/no-deal-brexit\"><span style=\"font-weight: 400\">policy thinktanks<\/span><\/a><span style=\"font-weight: 400\"> which had set out the risks involved. Exceptionally, the Royal Colleges had spoken out, with the <\/span><a href=\"https:\/\/twitter.com\/bbcnewsnight\/status\/1167197750275887108\"><span style=\"font-weight: 400\">President of the Royal College of Physicians<\/span><\/a><span style=\"font-weight: 400\"> making clear his lack of confidence in the government\u2019s reassurances.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Rees-Mogg\u2019s radio exchange with Nicholl had political consequences. A Conservative MP, Philip Lee, who is also a general practitioner, cited it as \u201c<\/span><a href=\"https:\/\/twitter.com\/BBCPolitics\/status\/1168932563731329025\"><span style=\"font-weight: 400\">the straw that broke the camel\u2019s back<\/span><\/a><span style=\"font-weight: 400\">\u201d after he defected to the Liberal Democrats, crossing the floor of the House of Commons on 4<\/span><span style=\"font-weight: 400\"> September as the prime minister was speaking.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">On 5<\/span><span style=\"font-weight: 400\"> September, Rees-Mogg stated twice in the House of Commons that he considered Nicholl to be \u201cas irresponsible as Dr [Andrew] Wakefield\u201d, the doctor responsible for the falsified (and subsequently <\/span><a href=\"https:\/\/www.thelancet.com\/journals\/lancet\/article\/PIIS0140-6736(97)11096-0\/fulltext\"><span style=\"font-weight: 400\">retracted<\/span><\/a><span style=\"font-weight: 400\">) 1998 paper linking the measles, mumps, and rubella (MMR) vaccine to autism. Several MPs immediately took to social media to express outrage that a \u201cwhistleblower\u201d doctor who had sought to draw attention to what he believed to be a significant threat to patient safety was being compared with one who had been found guilty of malpractice and <\/span><a href=\"https:\/\/www.bmj.com\/content\/340\/bmj.c2803\"><span style=\"font-weight: 400\">struck off<\/span><\/a><span style=\"font-weight: 400\"> the General Medical Council\u2019s register.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Chief Medical Officer for England, Professor Dame Sally Davies, expressed her concern in a <\/span><a href=\"https:\/\/twitter.com\/CMO_England\/status\/1169673321522388995\"><span style=\"font-weight: 400\">formal letter<\/span><\/a><span style=\"font-weight: 400\"> sent only hours after Rees-Mogg\u2019s statement. Describing the comparison with Wakefield as \u201cdisrespectful\u201d, Dame Sally reminded the Leader of the House that \u201cthe fraudulent and incorrect measles campaign launched by [Andrew Wakefield] resulted in the re-emergence of measles in this country\u201d.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">When he spoke in parliament, Rees-Mogg was protected by parliamentary <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Parliamentary_privilege\"><span style=\"font-weight: 400\">privilege<\/span><\/a><span style=\"font-weight: 400\">, a special right dating back to the 1689 Bill of Rights, designed to ensure that Members of Parliament could speak freely in the chamber secure in the knowledge that they would not be subject to challenge in the criminal or civil courts. Leaving aside general questions about when parliamentary privilege might be deemed to have been <\/span><a href=\"https:\/\/www.theguardian.com\/law\/2019\/apr\/09\/top-judge-attacks-growing-abuse-of-parliamentary-privilege\"><span style=\"font-weight: 400\">abused<\/span><\/a><span style=\"font-weight: 400\"> (and the requirements of the <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/826920\/August-2019-MINISTERIAL-CODE-FINAL-FORMATTED-2.pdf\"><span style=\"font-weight: 400\">Ministerial Code<\/span><\/a><span style=\"font-weight: 400\">), it is noteworthy that the prime minister himself was moved to state that he <\/span><a href=\"https:\/\/www.ft.com\/content\/18302630-d000-11e9-99a4-b5ded7a7fe3f\"><span style=\"font-weight: 400\">\u201cdoes not share\u201d<\/span><\/a><span style=\"font-weight: 400\"> the views expressed by his Right Honourable colleague.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">This recent incident raises the question of just how close the parallels of a no-deal Brexit could be to 1949 Vienna. Drug manufacture and supply chains are undoubtedly more globalised and interdependent, and many drugs on which lives depend are now <\/span><a href=\"https:\/\/www.bmj.com\/content\/366\/bmj.l5226\"><span style=\"font-weight: 400\">imported from the European Union<\/span><\/a><span style=\"font-weight: 400\">.\u00a0 <\/span><a href=\"https:\/\/www.theguardian.com\/politics\/2019\/sep\/04\/a-no-deal-brexit-under-boris-johnson-remains-a-threat-to-public-health\"><span style=\"font-weight: 400\">Patient groups<\/span><\/a><span style=\"font-weight: 400\"> have added their voices to a recent call from leading doctors, including the President of the Faculty of Public Health, for the government to make a clear commitment to <\/span><a href=\"https:\/\/www.fph.org.uk\/news-events\/media-centre\/fph-press-releases\/recent\/do-no-harm\/\"><span style=\"font-weight: 400\">\u201cdo no harm\u201d<\/span><\/a><span style=\"font-weight: 400\"> when making decisions on Brexit.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In her letter to Rees-Mogg, Sally Davies considered it entirely appropriate for doctors (and, she might have added, patients and citizens) to raise \u201cquestions regarding the ramifications of a disrupted distribution and consequent risk to life\u201d and that \u201c[p]olitical leaders should be prepared to answer these questions with respect\u201d.\u00a0\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Chief Medical Officer\u2019s intervention was timely and welcome, and seems very likely to have played a part in Rees Mogg\u2019s <a href=\"https:\/\/www.theguardian.com\/politics\/2019\/sep\/05\/rees-mogg-condemned-for-comparing-doctor-to-disgraced-anti-vaxxer-autism\">eventual apology<\/a> to Nicholl.\u00a0 Doctors treat patients without regard to their political views, and whistleblowers\u2019 alerts about risks to patient safety and wellbeing tend to be driven by professional commitments, not political ideology. Nicholl has been asking legitimate questions.
