{"id":45164,"date":"2019-07-23T17:54:58","date_gmt":"2019-07-23T16:54:58","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=45164"},"modified":"2019-07-25T10:59:26","modified_gmt":"2019-07-25T09:59:26","slug":"the-uk-governments-hostile-environment-is-harming-public-health","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2019\/07\/23\/the-uk-governments-hostile-environment-is-harming-public-health\/","title":{"rendered":"The UK government&#8217;s &#8220;hostile environment&#8221; is harming public health"},"content":{"rendered":"<p class=\"standfirst\">The enforcement of NHS collaboration with home office deportations is endangering vulnerable people and harming public health, say Sophie Weller and Rob Aldridge.<\/p>\n<p><!--more--><span style=\"font-weight: 400\">There is growing evidence that the government\u2019s &#8220;package&#8221; of hostile environment policies are causing serious harm to public health in the UK. We believe the precautionary principle that action should be taken to prevent harm even if some cause and-effect relationships have not been fully established scientifically now mandates that these policies should be immediately suspended pending a thorough, independent and transparent review into their health impacts. [1]<\/span><\/p>\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/wellcomeopenresearch.org\/articles\/4-109\/v1\">Our recent study of individuals forced to seek primary care<\/a>, outside of the NHS, at humanitarian organisation Doctors of the World UK (DOTW) in 2016 provides evidence that these policies are deterring vulnerable people from seeking healthcare for fear of arrest. [2] This is creating an environment where many are wrongly denied NHS care. A tenth of those attending DOTW clinics in 2016 had previously sought and been denied NHS care, with asylum seekers at highest risk. Individuals with an undocumented immigration status (the express targets of government hostile environment policy) were three times more likely than other attendees to report that they had not sought access to care at all, due to a &#8220;fear of arrest.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Evidence of harm is growing. The <\/span><a href=\"https:\/\/www.doctorsoftheworld.org.uk\/wp-content\/uploads\/import-from-old-site\/files\/Observatory_Report_2017_Executive_Summary.pdf\"><span style=\"font-weight: 400\">Medecins du Monde Observatory Report<\/span><\/a><span style=\"font-weight: 400\">, including 43,286 individuals from across Europe found that over half of those who reported &#8220;fear of arrest&#8221; as an obstacle to seeking healthcare, were in the UK. <\/span><a href=\"https:\/\/www.maternityaction.org.uk\/wp-content\/uploads\/WhatPriceSafeMotherhoodFINAL.pdf\"><span style=\"font-weight: 400\">A Maternity Action Report<\/span><\/a><span style=\"font-weight: 400\"> published in September 2018 makes for grim reading and provides compelling evidence that fear of incurring charges or being notified to the Home Office have a deterrent effect and lead to vulnerable pregnant women not seeking appropriate and timely care.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The dual strategy of the UK government in charging for NHS services and sharing non-clinical NHS data with the Home Office is particularly toxic in terms of health impacts. <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/418634\/Implementing_overseas_charging_regulations_2015.pdf\"><span style=\"font-weight: 400\">Charging regulations and guidance introduced in 2015<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/771515\/Guidance_on_implementing_the_overseas_visitor_charging_regulations.pdf\"><span style=\"font-weight: 400\">amended in 2017<\/span><\/a><span style=\"font-weight: 400\"> swept aside the longstanding principle that the NHS should be free at the point of access and required service providers to check entitlement and charge accordingly. Since 23 October 2017 upfront charging is mandated for overseas visitors requiring care which is not deemed urgent or immediately necessary and\/or which does not meet certain narrowly defined exemption criteria. The charging regulations do not cover treatment provided by a GP, however the system is poorly understood and individuals are often wrongly required to provide proof of ID, address and immigration status thus limiting access. [3] In our study the fact that individuals who are entitled to primary care nevertheless presented to DOTW clinics is evidence that these policies have broader unintended consequences. [2]\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In January 2017 the government made public a Memorandum of Understanding (MoU) between NHS Digital and the Home Office, with regards to the sharing of non-clinical data, describing it in <\/span><a href=\"https:\/\/www.parliament.uk\/documents\/commons-committees\/Health\/Correspondence\/2016-17\/Correspondence-Memorandum-Understanding-NHS-Digital-Home-Office-Department-Health-data-sharing.pdf\"><span style=\"font-weight: 400\">correspondence to the Health Select Committee<\/span><\/a> <span style=\"font-weight: 400\">as a formalisation of existing processes. Data sharing was introduced as part of the hostile environment and was aimed at increasing the identification and deportation of individuals who were deemed to be in contravention of UK immigration law.[4] The MoU was widely criticised and, following an <\/span><a href=\"https:\/\/www.parliament.uk\/business\/committees\/committees-a-z\/commons-select\/health-committee\/inquiries\/parliament-2017\/mou-data-sharing-nhs-digital-home-office-inquiry-17-19\/publications\/\"><span style=\"font-weight: 400\">Inquiry by the Health and Social Care Select Committee, <\/span><\/a><span style=\"font-weight: 400\">was suspended. Data sharing continues however, and under the <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/793132\/overseas-chargeable-patients-nhs-debt-and-immigration-rules.pdf\"><span style=\"font-weight: 400\">charging regulations and current guidance (2019<\/span><\/a><span style=\"font-weight: 400\">) <\/span><span style=\"font-weight: 400\">patients who owe \u00a3500 or more, are reported to the Home Office two months following invoice, and such debt can negatively affect future immigration applications.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The government has refused to publish a review that has been conducted into the impact of the 2017 changes while simultaneously relying on the findings of no deterrent effect\/no public health impact <\/span><a href=\"https:\/\/www.parliament.uk\/business\/publications\/written-questions-answers-statements\/written-statement\/Commons\/2018-12-12\/HCWS1174\/\"><span style=\"font-weight: 400\">in Parliament<\/span><\/a><span style=\"font-weight: 400\">. In <\/span><a href=\"http:\/\/data.parliament.uk\/writtenevidence\/committeeevidence.svc\/evidencedocument\/health-and-social-care-committee\/governments-review-of-nhs-overseas-visitor-charging\/oral\/103497.html\"><span style=\"font-weight: 400\">oral evidence to the Health Select Committee on 21 June 2019,<\/span><\/a><span style=\"font-weight: 400\"> faced with clear examples of &#8220;harm&#8221;, the Minister of State for Health appeared to argue that any such &#8220;harm&#8221; was a result of failures in the &#8220;application&#8221; of the regulations by NHS trusts. However, poor policy is liable to be poorly applied and the damning criticism <\/span><a href=\"https:\/\/www.instituteforgovernment.org.uk\/sites\/default\/files\/publications\/IfG-Migration-After-Brexit_4.pdf\"><span style=\"font-weight: 400\">in a recent report by the Institute for Government<\/span><\/a><span style=\"font-weight: 400\"> shows that determining a person\u2019s immigration status (a prerequisite of both policies) is far from straightforward and is a fluid process. The report also identifies flaws in policy-making including <\/span><a href=\"https:\/\/www.instituteforgovernment.org.uk\/summary-managing-migration-after-brexit\"><span style=\"font-weight: 400\">&#8220;weak evidence and evaluation&#8221; and a &#8220;lack of effective scrutiny&#8221;<\/span><\/a><span style=\"font-weight: 400\"> perpetuated by alleged deliberate failures to publish reports in a timely fashion. [5]<\/span><\/p>\n<p><span style=\"font-weight: 400\">In these circumstances, the balance is clear and there can be no justification for further delays endangering the health of vulnerable individuals and public health more broadly.
