{"id":45152,"date":"2019-07-19T15:54:32","date_gmt":"2019-07-19T14:54:32","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=45152"},"modified":"2019-07-30T11:53:53","modified_gmt":"2019-07-30T10:53:53","slug":"implications-of-no-deal-brexit-for-orphan-and-paediatric-medicines","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2019\/07\/19\/implications-of-no-deal-brexit-for-orphan-and-paediatric-medicines\/","title":{"rendered":"Implications of &#8220;no deal&#8221; Brexit for orphan and paediatric medicines"},"content":{"rendered":"<p class=\"standfirst\">In the event of a &#8220;no deal&#8221; Brexit some of the UK&#8217;s most vulnerable, especially children with rare diseases, may lose access to the best medicine available, say <span style=\"font-weight: 400\">Stuart Elborn,<\/span> <span style=\"font-weight: 400\">Mark Flear,<\/span><span style=\"font-weight: 400\">\u00a0<\/span><span style=\"font-weight: 400\">and Damian Downey.\u00a0<\/span><\/p>\n<p><!--more--><span style=\"font-weight: 400\">The UK has built up a very strong clinical trials infrastructure funded and supported through the National Institute of Health Research and equivalents in the devolved nations, the Medical Research Council, Wellcome Trust, and many other medical charities. This infrastructure supports participation by UK patients in international clinical trials. As a result of this infrastructure <a href=\"https:\/\/www.abpi.org.uk\/publications\/clinical-trials-a-report-from-the-ministerial-industry-strategy-group-clinical-research-working-group\/\">the contribution of patients in the UK exceeds that of many other EU countries. <\/a><\/span><span style=\"font-weight: 400\">[1]<\/span><span style=\"font-weight: 400\"> It has long been manifestly clear that withdrawal of the United Kingdom (UK) from the European Union (EU) (Brexit) would have considerable adverse consequences on pharmaceutical research and development and access in the UK. Brexit is currently scheduled to occur on 31 October 2019. Nevertheless, little has been said about the consequences of Brexit for the development of and access to medicines for orphan (rare) diseases and children.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Those that use and need paediatric and orphan medicines currently benefit from the favourable regulatory environment set-up under the relevant EU legislation. <\/span><span style=\"font-weight: 400\">[2] <\/span><span style=\"font-weight: 400\">This environment includes: fee waivers for market authorisation applications; 10 year market exclusivity for new orphan medicines; the possibility of extending the term of patent exclusivity for a new paediatric medicine, operating for a fixed period from the date of the first marketing authorisation in an EU Member State. For paediatric medicines that are also orphan medicines, there is the possibility of an additional two years of market exclusivity.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Boris Johnson, the frontrunner to take over from Theresa May as UK prime minister has, so far at least, committed to achieving Brexit by 31 October 2019. Johnson\u2019s apparent rejection of <a href=\"https:\/\/ec.europa.eu\/commission\/sites\/beta-political\/files\/draft_withdrawal_agreement_0.pdf\">the Withdrawal Agreement<\/a> agreed (but not yet ratified) between the UK and EU on 25 November 2018, <\/span><span style=\"font-weight: 400\">[3]<\/span><span style=\"font-weight: 400\"> means that it is unlikely to form the basis for an orderly withdrawal, and the UK may leave the EU with &#8220;no deal.&#8221; Under the Withdrawal Agreement, EU law would continue to apply until the end of December 2020, with the possibility of extension for up to two years. With the Withdrawal Agreement apparently defunct, it becomes essential to consider the implications of &#8220;no deal.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400\">A statutory instrument (SI) issued under the European Union (Withdrawal) Act 2018 amends the Human Medicines Regulations 2012 (2012 Regulations) and provides that EU legislation for orphan and paediatric medicines would no longer apply in the UK in the event of &#8220;no deal.&#8221; <\/span><span style=\"font-weight: 400\">[4] <\/span><span style=\"font-weight: 400\">The SI provides that medicines authorised immediately before exit day under the centralised procedure overseen by the European Medicines Agency (EMA), <\/span><span style=\"font-weight: 400\">[5] <\/span><span style=\"font-weight: 400\">which includes orphan and paediatric medicines, would be given a UK marketing authorisation. Applications to the EMA that are in progress on exit day would be considered by the Medicines and Healthcare related products Regulatory Agency (MHRA) in applications to it for a UK marketing authorisation. The SI also appears to provide that the incentives relating to orphan and paediatric medicines remain part of UK law post-Brexit via the amended 2012 Regulations.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Still, it remains questionable whether these incentives, but with significantly reduced population groups and thus far smaller markets, would produce the regulatory environment needed to incentivise research, development, and marketing within the UK\u2019s market alone. A particular point in respect of orphan medicines is that the SI contains at least one major stumbling block to their development. In relation to the definition of the population for the designation of an orphan medicine, the SI essentially copies the relevant provision in EU legislation and substitutes &#8220;UK&#8221; for the &#8220;Community&#8221; (i.e. the EU). This is despite the reduced potential for UK-only populations amounting to not more than five in 10 thousand persons for certain diseases. <\/span><span style=\"font-weight: 400\">[6]<\/span><span style=\"font-weight: 400\"> There is clearly greater potential for such populations in the far larger EU-wide population (the EU legislative provision was drafted with the latter in mind).<\/span><\/p>\n<p><span style=\"font-weight: 400\">More generally, the MHRA would have to develop and apply a UK regulatory profile to bring medicines through to market authorisation. This would be at considerable cost to the UK taxpayer. Pharmaceutical companies would have to ensure applications for market authorisation are precisely tailored to fit the regulatory profile that is required in the UK. This is a disincentive to industry seeking market authorisation in the UK ahead of, or in parallel to, the EU. Pharmaceutical companies usually prioritise market authorisation in the United States of America (USA) with the EU as the second highest priority. This is precisely because these markets are the most economically attractive. Market authorisations in smaller markets e.g. the UK alone would be a lower priority. A further disincentive to seek market authorisation in the UK might come from the health technology assessments undertaken by the National Institute for Clinical Excellence. These assessments already result in UK-based patients having delayed access to treatments. These considerable disincentives are likely to result in delayed market authorisation in the UK compared to the USA and the EU post-Brexit.<\/span><\/p>\n<p><span style=\"font-weight: 400\">These various factors mean that new orphan and paediatric medicines are more likely to be placed on the market in the EU (and US) sooner than within the UK. Consequently, current and future UK participants in clinical trials that produce data for the market authorisation of these medicines within the EU are likely to gain access to them later than patients and consumers within the EU. <\/span><span style=\"font-weight: 400\">[7]<\/span><span style=\"font-weight: 400\"> This is a further disincentive to clinical trials of new medicines in the UK. Double-blind randomised controlled trials involve testing a new medicine against the best available medicine in order to prove efficacy and safety. But the best available medicine might not always be marketed in the UK, particularly where market authorisation under the centralised procedure occurs post-Brexit. Overall, research and development might move away from the UK due to the comparatively less hospitable regulatory environment there post-Brexit.<\/span><\/p>\n<p><span style=\"font-weight: 400\">It has been suggested that Brexit might provide an opportunity to create <a href=\"https:\/\/www.ft.com\/content\/4560f016-3a2b-11e7-ac89-b01cc67cfeec\">a more flexible UK regulatory framework<\/a> for clinical trials. <\/span><span style=\"font-weight: 400\">[8]<\/span><span style=\"font-weight: 400\"> However, as we have indicated, a &#8220;no deal&#8221; Brexit is not likely to yield any advantage for the development of and access to orphan and paediatric medicines.
