{"id":44840,"date":"2019-06-19T12:02:15","date_gmt":"2019-06-19T11:02:15","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=44840"},"modified":"2019-06-28T15:33:11","modified_gmt":"2019-06-28T14:33:11","slug":"drugs-are-decriminalised-in-the-uk-if-you-are-a-white-privileged-mp","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2019\/06\/19\/drugs-are-decriminalised-in-the-uk-if-you-are-a-white-privileged-mp\/","title":{"rendered":"Drugs are decriminalised in the UK\u2014if you are a white, privileged MP"},"content":{"rendered":"<p class=\"standfirst\"><span style=\"font-weight: 400\">It is time to end this hypocrisy, says Niamh Eastwood<\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-weight: 400\">\u201cIf any of us lapse sometimes from standards we uphold, that is human, the thing to do is not necessarily to say the standards should be lowered, it should be to reflect on the lapse, and to seek to do better in the future.\u201d This is what <\/span><a href=\"https:\/\/www.bbc.co.uk\/iplayer\/episode\/m0005xjm\/the-andrew-marr-show-09062019\"><span style=\"font-weight: 400\">Michael Gove said<\/span><\/a><span style=\"font-weight: 400\"> on the Andrew Marr show recently in respect of his own his cocaine use. He has been accused of hypocrisy after it emerged that he has previously criticised <\/span><a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/michael-gove-drug-article-hypocrisy_uk_5cfce6aae4b0aab91c078dd0\"><span style=\"font-weight: 400\">middle class drug use,<\/span><\/a><span style=\"font-weight: 400\"> as secretary of state for education he oversaw a policy to <\/span><a href=\"https:\/\/www.theguardian.com\/politics\/2019\/jun\/09\/michael-goves-conservative-leadership-prime-minister-cocaine-admission\"><span style=\"font-weight: 400\">end the careers of teachers<\/span><\/a><span style=\"font-weight: 400\"> who took Class A drugs, and as justice secretary he oversaw a system in which people could face up to seven years in prison for possession.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This hypocrisy is not limited to Gove; <\/span><a href=\"https:\/\/www.theguardian.com\/politics\/2019\/jun\/09\/high-tories-how-the-leadership-candidates-drug-pasts-compare\"><span style=\"font-weight: 400\">all bar one of the remaining candidates<\/span><\/a><span style=\"font-weight: 400\"> have admitted to using controlled drugs. All have expressed regret, some have described their drug use as youthful indiscretion, yet none have suggested we need to reform our drugs laws. The real problem of course is not \u201cstandards\u201d or a need for individuals to \u201creflect on the lapse.\u201d The problem is that drug policy in the UK is an utter failure, and that these admissions simply serve as more evidence of this failed policy and a deep cognitive dissonance exhibited by the people seeking to occupy No 10. <\/span><\/p>\n<p><span style=\"font-weight: 400\">It is hard not to be angry when you look at the ages of those criminalised for possession of a controlled drug for their own personal use. Of the <\/span><a href=\"https:\/\/www.gov.uk\/government\/statistics\/criminal-justice-system-statistics-quarterly-december-2018\"><span style=\"font-weight: 400\">35,594 people criminalised<\/span><\/a><span style=\"font-weight: 400\"> for this activity in 2018, 41 per cent were under 24 years old. In place of the freedom to \u201creflect\u201d on their actions, those who are criminalised receive punishment that affects their quality of life, be it employment prospects, educational aspirations, or the ability to travel to other countries. Imagine the injustice of having to disclose at every job interview that you have a criminal record, unlike politicians who seem only to disclose when there is a risk they will be exposed. <\/span><\/p>\n<p><span style=\"font-weight: 400\">These MPs seem to think that our drug laws work\u2014that they deter use\u2014but somehow this deterrence had no effect on them. If they had taken time to research the effectiveness of our drug laws they might simply have referred to the Home Office\u2019s own research: a <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/368489\/DrugsInternationalComparators.pdf\"><span style=\"font-weight: 400\">2014 report<\/span><\/a><span style=\"font-weight: 400\"> comparing the legal framework of other countries which concluded that there was no evidence that tough law enforcement approaches had any impact on levels of use. In fact, the <\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/628100\/Drug_Strategy_Evaluation.PDF\"><span style=\"font-weight: 400\">Home Office has stated<\/span><\/a><span style=\"font-weight: 400\"> that despite spending \u00a31.6 billion a year on law enforcement tackling the illicit drugs trade, it has had little impact on the availability of drugs, and describes the market as \u201cresilient\u201d. These findings are a damning indictment of the failed approach we have to drugs in this country. While the likely \u201clapse\u201d in judgement of our soon-to-be prime minister did not result in arrest, charge, or prosecution, across the country everyday people are criminalised for the same activities.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Our drug laws\u2014and punitive drug laws in general\u2014double down most <\/span><a href=\"https:\/\/www.release.org.uk\/publications\/ColourOfInjustice\"><span style=\"font-weight: 400\">heavily on people of colour and those who live in areas of deprivation<\/span><\/a><span style=\"font-weight: 400\"> with little recourse to economic privilege. Black people are nine times more likely to be stopped and searched for drugs and\u2014despite using controlled substances at a lower rate than the white population\u2014most of these searches are for personal possession. When searched, black people are less likely to be found in possession of drugs; if caught in possession, they are more likely to receive harsher punishments. For example, black people are 12 times more likely to be sentenced for cannabis possession compared to the white population\u2014despite the fact they are less likely to use that drug.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Politicians need to engage with \u00a0the evidence. Disclosing use of a controlled drug should not bar someone from public office\u2014supporting the continuation of our damaging drug laws should. Across the world <\/span><a href=\"https:\/\/www.release.org.uk\/publications\/drug-decriminalisation-2016\"><span style=\"font-weight: 400\">countries have ended criminal sanctions<\/span><\/a><span style=\"font-weight: 400\"> for possession of drugs; done well and coupled with investment in harm reduction and treatment, the results will have a positive effect on the health of some of the most vulnerable in society. We only need to look to <\/span><a href=\"http:\/\/www.emcdda.europa.eu\/system\/files\/publications\/11331\/portugal-cdr-2019_0.pdf\"><span style=\"font-weight: 400\">Portugal<\/span><\/a><span style=\"font-weight: 400\">, which ended criminal sanctions for personal possession in 2001: drug-related deaths in that country are now 4 per million of the population compared to <\/span><a href=\"http:\/\/www.emcdda.europa.eu\/system\/files\/publications\/11355\/united-kingdom-cdr-2019.pdf\"><span style=\"font-weight: 400\">74 per million in the UK<\/span><\/a><span style=\"font-weight: 400\">. <\/span><\/p>\n<p><span style=\"font-weight: 400\">We are facing a public health crisis with people dying at unprecedented rates. The Home Office, and next prime minister, must reflect on the failures of drugs prohibition and seek to do better, starting now, so that the future is brighter than the state-sanctioned stigma, criminalisation and death that the status quo promises.
