{"id":44557,"date":"2019-05-09T10:57:57","date_gmt":"2019-05-09T09:57:57","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=44557"},"modified":"2019-05-17T11:12:58","modified_gmt":"2019-05-17T10:12:58","slug":"jenny-vaughan-the-bawa-garba-case-should-usher-in-a-fairer-culture-in-healthcare","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2019\/05\/09\/jenny-vaughan-the-bawa-garba-case-should-usher-in-a-fairer-culture-in-healthcare\/","title":{"rendered":"Jenny Vaughan: The Bawa-Garba case should usher in a fairer culture in healthcare"},"content":{"rendered":"<p class=\"standfirst\">Jenny Vaughan looks at the end of a case that&#8217;s lit the blue touch paper for a whole generation of doctors<\/p>\n<p><!--more--><span style=\"font-weight: 400\">Last month a medical practitioners tribunal<\/span> <span style=\"font-weight: 400\">ruled that Hadiza Bawa-Garba can <\/span><a href=\"https:\/\/www.bmj.com\/content\/365\/bmj.l1702\"><span style=\"font-weight: 400\">return to work under close supervision<\/span><\/a><span style=\"font-weight: 400\">. It was agreed that her suspension, which is due to end in July 2019, has served the public interest and any higher sanction would be \u201c<\/span><a href=\"https:\/\/www.mpts-uk.org\/-\/media\/mpts-rod-files\/dr-hadiza-bawa-garba-09-april-2019.pdf\"><span style=\"font-weight: 400\">disproportionate and punitive<\/span><\/a><span style=\"font-weight: 400\">.\u201d Before allowing her to resume practice, the Medical Practitioners Tribunal Service (MPTS) wanted to be sure that she had insight into the consequences of her actions and it is now satisfied that she does. Bawa-Garba\u2019s journey through the criminal justice system is widely known and has been followed with <\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/08\/14\/jenny-vaughan-the-long-road-to-justice-for-hadiza-bawa-garba\"><span style=\"font-weight: 400\">close interest<\/span><\/a><span style=\"font-weight: 400\"> by the <\/span><span style=\"font-weight: 400\">medical community<\/span><span style=\"font-weight: 400\">. <\/span><\/p>\n<p><span style=\"font-weight: 400\">When the <\/span><a href=\"https:\/\/www.bmj.com\/content\/358\/bmj.j4023\"><span style=\"font-weight: 400\">General Medical Council (GMC) appealed for her to be struck off the medical register<\/span><\/a><span style=\"font-weight: 400\">, it lit the blue touch paper for a whole generation of doctors working in very challenging conditions across the country. Many of these doctors were simply not prepared to accept the <\/span><a href=\"https:\/\/www.bmj.com\/content\/360\/bmj.k417\"><span style=\"font-weight: 400\">High Court\u2019s subsequent verdict<\/span><\/a><span style=\"font-weight: 400\"> in January 2018 that Bawa-Garba should be erased from the medical register. And while the GMC\u2019s appeal was initially successful, its pyrrhic victory was to be short lived. An unprecedented crowdfunding appeal raised more than \u00a3350 000 for Bawa-Garba to hire a new legal team and launch an appeal. In <\/span><a href=\"https:\/\/www.bmj.com\/content\/362\/bmj.k3510\"><span style=\"font-weight: 400\">August 2018 the appeal court rejected the High Court\u2019s decision<\/span><\/a><span style=\"font-weight: 400\"> to allow the GMC to erase Bawa-Garba\u2019s name from the medical register. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Jack Adcock should have received better care: there are many lessons to be learnt from his death. However, Bawa-Garba was not the only one whose honest errors contributed to his death. The hospital\u2019s systems also broke down that day, which contributed to the mistakes that were made. It is hard for a jury to gain a real understanding of just how far these systemic factors can impact the decision making of a doctor. It was these system level issues that struck a chord with many doctors following the case. Yet<\/span><span style=\"font-weight: 400\"> subsequent reports of the case<\/span><span style=\"font-weight: 400\"> have described how even after Jack\u2019s death there was still evidence at the Leicester Royal Infirmary of \u201c<a href=\"https:\/\/www.bbc.co.uk\/news\/resources\/idt-sh\/the_struck_off_doctor\">poor staffing levels; communication problems and poor handovers; IT systems not working<\/a>.\u201d <\/span><span style=\"font-size: 1rem\">There were also ongoing issues of <a href=\"https:\/\/www.bbc.co.uk\/news\/resources\/idt-sh\/the_struck_off_doctor\">senior staff supervision of trainees<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Recent <\/span><a href=\"https:\/\/improvement.nhs.uk\/resources\/just-culture-guide\/\"><span style=\"font-weight: 400\">guidance from NHS Improvement<\/span><\/a><span style=\"font-weight: 400\"> raises questions about the decision to prosecute individuals working in scenarios where there have been system failings. As their \u201c<\/span><a href=\"https:\/\/improvement.nhs.uk\/documents\/2490\/NHS_0690_IC_A5_web_version.pdf\"><span style=\"font-weight: 400\">Just culture\u201d guide<\/span><\/a><span style=\"font-weight: 400\"> says, \u201cAction singling out an individual is rarely appropriate. Most patient safety issues have deeper causes and require wider action.\u201d <\/span><a href=\"https:\/\/www.bmj.com\/content\/360\/bmj.k1376\"><span style=\"font-weight: 400\">\u00a0Ian Kennedy QC has called for a rethink<\/span><\/a><span style=\"font-weight: 400\"> of the criminal law in cases of medical manslaughter. And <\/span><a href=\"https:\/\/www.bmj.com\/content\/363\/bmj.k4412\"><span style=\"font-weight: 400\">Robert Francis QC<\/span><\/a><span style=\"font-weight: 400\"> has directly raised doubts about the ability of a lay jury to understand what is \u201ctruly, exceptionally bad\u201d when it comes to medical error compared with other types of crime, e.g. theft, where the jury are told what the elements of the offence are. In gross negligence manslaughter, the risk is that the jury have to apply a retrospective judgment as to the &#8220;seriousness&#8221; of what happened. This can give rise to inconsistencies in healthcare because of the <\/span><a href=\"https:\/\/www.dauk.org\/blog\/2018\/10\/22\/what-is-stopping-you-doing-something-that-is-patently-sensible-jenny-vaughan-on-the-hsc-inquiry-and-the-questions-put-to-the-gmc\"><span style=\"font-weight: 400\">complexities that commonly provide the backdrop to a clinical case<\/span><\/a><span style=\"font-weight: 400\">, including the role of others and hospital systems.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bawa-Garba was convicted of gross negligence manslaughter, and while the safety of such a conviction may be challenged in the future, it remains in place for now. The findings of <\/span><a href=\"https:\/\/www.gmc-uk.org\/news\/news-archive\/gmc-announces-terms-of-reference-for-gross-negligence-manslaughter-review\"><span style=\"font-weight: 400\">a GMC independent<\/span><\/a><span style=\"font-weight: 400\"> review into gross negligence manslaughter and healthcare are awaited, but it is hoped that they will make recommendations to usher in a fairer culture in healthcare. <\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/03\/13\/rob-hendry-gross-negligence-manslaughter-does-not-exist-in-scotland-is-it-time-to-move-english-law-towards-the-scottish-position\"><span style=\"font-weight: 400\">Scottish law appears to have allowed the development of a less punitive culture in healthcare<\/span><\/a><span style=\"font-weight: 400\">, and it would be useful for any learning from this system to be adopted in England and Wales. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The landscape has changed considerably after the successful appeal against conviction of the surgeon <a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/03\/20\/the-case-of-david-sellu-a-criminal-court-is-not-the-right-place-to-determine-blame-in-complex-clinical-cases\/\">David Sellu<\/a>.<\/span> <span style=\"font-weight: 400\">Yet we still await further guidance on how a better understanding will be achieved between the Crown Prosecution Service, medical experts, and the defence societies as to what kind of avoidable deaths should be examined in a criminal court. The training of medical experts in human factors would help to make a difference, but a range of recommendations will need to be acted upon. Otherwise, we risk a whole generation of those who want to care simply voting with their feet. <\/span><\/p>\n<p><span style=\"font-weight: 400\">This case has caused enormous controversy. Bawa-Garba may be planning to return to work early next year, but doctors across the world remain concerned that, as a result of this case, if they miss a diagnosis they might be convicted of manslaughter and erased as Bawa-Garba was. Undertaking a lecture tour of both Australia and New Zealand recently, I had the privilege of speaking to doctors from across the globe. The appetite for trying to understand how the UK managed to convict a paediatric trainee, in such demanding circumstances, remains undimmed. <\/span><\/p>\n<p><span style=\"font-weight: 400\">It is encouraging that politically there is now much more of an acceptance that the \u201cblame culture\u201d in the NHS must end and be replaced by a just culture. In an extraordinary move, the then health secretary Jeremy Hunt intervened to <a href=\"https:\/\/www.bmj.com\/content\/360\/bmj.k456\">question the judgment of the GMC<\/a> when it appealed to have Bawa-Garba struck off and he has subsequently called her reinstatement \u201cexcellent news.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400\">Going forward, our focus should be on building a truly just culture in healthcare and ensuring that the wider system, including hospital systems (<\/span><a href=\"https:\/\/www.dailymail.co.uk\/news\/article-3174741\/A-scalpel-hospital-buried-evidence-clear-surgeon-jailed-patient-s-death-40-year-exemplary-career.html\"><span style=\"font-weight: 400\">both NHS and private<\/span><\/a><span style=\"font-weight: 400\">), do not escape scrutiny. The <\/span><a href=\"https:\/\/www.gov.uk\/government\/publications\/williams-review-into-gross-negligence-manslaughter-in-healthcare\"><span style=\"font-weight: 400\">Williams review<\/span><\/a><span style=\"font-weight: 400\"> suggested that the Care Quality Commission should be informed of all gross negligence manslaughter referrals to the Crown Prosecution Service, so that they can consider if a parallel investigation is required to determine the role of systemic and human factors and identify any changes which might be needed. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The GMC\u2019s <\/span><a href=\"https:\/\/www.thelancet.com\/journals\/lancet\/article\/PIIS0140-6736(18)30838-9\/fulltext\"><span style=\"font-weight: 400\">authority as a regulator has been weakened<\/span><\/a><span style=\"font-weight: 400\"> by these events. The Williams review recommended that the GMC\u2019s right <\/span><a href=\"https:\/\/www.bmj.com\/content\/361\/bmj.k2779\"><span style=\"font-weight: 400\">to appeal MPTS decisions should be removed<\/span><\/a><span style=\"font-weight: 400\">. Yet the fact that<\/span><a href=\"http:\/\/www.pulsetoday.co.uk\/your-practice\/regulation\/gmc-to-continue-appealing-ftp-decisions-until-legislation-is-changed\/20036961.article\"><span style=\"font-weight: 400\"> it is still <\/span><span style=\"font-weight: 400\">appealing these decisions<\/span><\/a><span style=\"font-weight: 400\"> has raised questions in the minds of many as to whether it has truly learnt from what happened. As the BMA chair Chaand Nagpaul <\/span><a href=\"http:\/\/www.pulsetoday.co.uk\/news\/bawa-garba-a-journey-from-hell-to-redemption\/20038538.article\"><span style=\"font-weight: 400\">said at the time<\/span><\/a><span style=\"font-weight: 400\">: \u201cThe GMC\u2019s decision to appeal a decision of its own tribunal service meant it lost the trust and confidence of many doctors.\u201d Many expected greater insight, especially as this quality appears to be so important in GMC investigations and is expected (rightly) of the individual doctor. Ramesh Mehta, president of BAPIO, <\/span><a href=\"https:\/\/www.bapio.co.uk\/bapio-proud-of-its-contribution-to-bawa-garba-victory-against-gmc\/\"><span style=\"font-weight: 400\">noted that<\/span><\/a><span style=\"font-weight: 400\"> [The GMC should] \u201creflect on the immense stress that their processes have caused to doctors who are often unnecessarily put through lengthy regulatory investigation.\u201d This spotlight on the GMC has focused our minds on the excess referral rates that BME doctors experience for fitness to practise investigations. Many factors underpin this and the GMC has constructively instructed <\/span><a href=\"https:\/\/www.gmc-uk.org\/news\/news-archive\/gmc-commissions-new-research-into-fitness-to-practise-referrals\"><span style=\"font-weight: 400\">Roger Kline and Doyin Atewologun to undertake a review<\/span><\/a><span style=\"font-weight: 400\">, which is due to report soon. <\/span><\/p>\n<p><span style=\"font-weight: 400\">In pursuit of a more just culture, and as part of <\/span><a href=\"https:\/\/www.dauk.org\/learnnotblamedauk\"><span style=\"font-weight: 400\">the Doctor\u2019s Association<\/span><\/a><span style=\"font-weight: 400\">, we have launched a campaign \u201cLearn Not Blame,\u201d currently led by Cicely Cunningham and Samatha Batt-Rawden who rightly point out that \u201cfear, blame, and criminalisation of honest error . . . does nothing for patient safety.\u201d The current efflux of trainees abroad, coupled with senior doctors retiring early, is creating an unsustainable health service with a worsening blame culture. Bawa-Garba herself has said that she hopes her journey will in \u201csome way improve [the] working conditions of many junior doctors\u201d (BBC Panorama) and many would echo that wish. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Organisational learning is vital so that politicians, hospitals, and our regulator conduct their business in a fairer way, with a better understanding of the pressures facing all frontline clinicians. We must, however, remain accountable.
