The Human Medicines Regulations 2012 and advertising"},"content":{"rendered":"<p><a href=\"https:\/\/blogs.bmj.com\/bmj\/files\/2014\/12\/jeffrey_aronson.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-32935\" src=\"https:\/\/blogs.bmj.com\/bmj\/files\/2014\/12\/jeffrey_aronson-223x300.jpg\" alt=\"jeffrey_aronson\" width=\"122\" height=\"146\" \/><\/a><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/11\/16\/jeffrey-aronson-when-i-use-a-word-regime-regimen-regiment-and-regulation\/\"><span style=\"font-weight: 400\">Last week<\/span><\/a><span style=\"font-weight: 400\"> I discussed how the <\/span><a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1968\/67\/pdfs\/ukpga_19680067_en.pdf\"><span style=\"font-weight: 400\">Medicines Act 1968<\/span><\/a><span style=\"font-weight: 400\"> enabled the promulgation of the <\/span><a href=\"http:\/\/www.legislation.gov.uk\/uksi\/2012\/1916\/contents\/made\"><span style=\"font-weight: 400\">Human Medicines Regulations 2012<\/span><\/a><span style=\"font-weight: 400\">, which replaced the Act and about 200 other pieces of secondary legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Medicines Act contained 136 sections in eight parts plus eight appended schedules. In contrast, the Human Medicines Regulations contains 349 sections in 17 parts plus 35 appended schedules. The general correspondences between the two are shown in Table 1 below. I do not intend to make a detailed direct comparison between the two. I have previously discussed the <\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/10\/05\/jeffrey-aronson-when-i-use-a-word-licensing-authorization-and-the-medicines-act-1968\"><span style=\"font-weight: 400\">licensing<\/span><\/a><span style=\"font-weight: 400\"> of medicines and how they are <\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/10\/12\/jeffrey-aronson-when-i-use-a-word-the-medicines-act-1968-and-advertising-medicinal-products\"><span style=\"font-weight: 400\">advertised<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/10\/19\/jeffrey-aronson-when-i-use-a-word-the-medicines-act-1968-data-sheets-and-summaries-of-product-characteristics\"><span style=\"font-weight: 400\">described<\/span><\/a><span style=\"font-weight: 400\"> in the light of the Medicines Act 1968. Here I shall describe how the major parts of the 2012 Regulations deal with advertising, to exemplify the similarities and differences.<\/span><\/p>\n<p><b>Table 1.<\/b><span style=\"font-weight: 400\"> A brief comparison of the contents of the Human Medicines Regulations 2012 and the Medicines Act 1968; for complete details see the <\/span><a href=\"http:\/\/www.legislation.gov.uk\/uksi\/2012\/1916\/note\/made\"><span style=\"font-weight: 400\">Explanatory Note<\/span><\/a><span style=\"font-weight: 400\"> at the end of the former<\/span><br \/>\n<a href=\"https:\/\/blogs.bmj.com\/bmj\/files\/2018\/11\/aronson_regulation_table.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-43492 size-large\" src=\"https:\/\/blogs.bmj.com\/bmj\/files\/2018\/11\/aronson_regulation_table-468x1024.png\" alt=\"\" width=\"468\" height=\"1024\" srcset=\"https:\/\/blogs.bmj.com\/bmj\/files\/2018\/11\/aronson_regulation_table-468x1024.png 468w, https:\/\/blogs.bmj.com\/bmj\/files\/2018\/11\/aronson_regulation_table-137x300.png 137w, https:\/\/blogs.bmj.com\/bmj\/files\/2018\/11\/aronson_regulation_table.png 621w\" sizes=\"auto, (max-width: 468px) 100vw, 468px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400\">The Medicines Act 1968 (\u00a792\u201397) made it illegal to give false or misleading information and to advertise unauthorized (i.e. \u201c<\/span><a href=\"https:\/\/blogs.bmj.com\/bmj\/2018\/10\/05\/jeffrey-aronson-when-i-use-a-word-licensing-authorization-and-the-medicines-act-1968\"><span style=\"font-weight: 400\">off-label<\/span><\/a><span style=\"font-weight: 400\">\u201d) recommendations. The Act also empowered the licensing authority to require copies of any advertisements and data sheets relating to medicinal products to be provided, and to ensure that they contained adequate information, did not include misleading information, and promoted safety.<\/span><\/p>\n<p><span style=\"font-weight: 400\">These provisions are retained in the 2012 Regulations (\u00a7282\u2013303) but the Regulations are more extensive and include additional provisions, such as those relating to advertisements wholly or mainly directed at members of the public (\u00a7283\u2013292), proscribing, for example:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements likely to lead to the use of a medicinal product for the purpose of inducing an abortion;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements for prescription only medicines and for substances listed in Schedules I, II, or IV to the <\/span><a href=\"https:\/\/www.unodc.org\/documents\/commissions\/CND\/Int_Drug_Control_Conventions\/Ebook\/The_International_Drug_Control_Conventions_E.pdf\"><span style=\"font-weight: 400\">Narcotic Drugs Convention<\/span><\/a><span style=\"font-weight: 400\"> or in Schedules I to IV to the <\/span><a href=\"https:\/\/www.unodc.org\/documents\/commissions\/CND\/Int_Drug_Control_Conventions\/Ebook\/The_International_Drug_Control_Conventions_E.pdf\"><span style=\"font-weight: 400\">Psychotropic Substances Convention<\/span><\/a><span style=\"font-weight: 400\">;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements that state or imply that a medical consultation or surgical operation is unnecessary, that offer to provide a diagnosis or suggest a treatment by post or by means of an electronic communications network, or that might, by a description or detailed representation of a case history, lead to erroneous self-diagnosis;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements that suggest that the effects of taking the medicinal product are guaranteed, are better than or equivalent to those of another identified treatment or product, or are not accompanied by any adverse reaction;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements that use misleading or alarming pictorial representations of changes in the human body caused by disease or injury or that misleadingly or alarmingly refer to claims of recovery;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements that suggest that health in the absence of disease or injury could be enhanced by taking the product or affected by not taking it;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements directed principally at children<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">These Regulations do not apply to advertisements for approved vaccines or sera in vaccination campaigns.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Regulations proscribe abbreviated advertisements, which in essence means that they must contain information about adverse reactions, precautions, contraindications, and method of use, or at least a statement that the information can be found at a given website address.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Other provisions relate to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">promotion of medicinal products by medical sales representatives;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">free samples for persons qualified to prescribe or supply medicinal products;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">inducements and hospitality, although without defining the meaning of \u201cinexpensive\u201d;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements for registered homoeopathic medicinal products;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">advertisements for traditional herbal medicinal products.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">I have previously suggested that the provisions in the Medicines Act 1968 may have contributed to the decline in advertising of medicinal products that occurred during the 1970s and 1980s.
