Raj Bhopal\u2019s <\/span><a href=\"https:\/\/www.bmj.com\/content\/361\/bmj.k2145\/rr\"><span style=\"font-weight: 400\">rapid response in <\/span><i><span style=\"font-weight: 400\">The BMJ<\/span><\/i><\/a><span style=\"font-weight: 400\">, in which he objected to the use of the phrase \u201cillegal migrant\u201d on the grounds that only actions, not persons, can be deemed \u201cillegal\u201d, merits further reflection and dissection.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Some people think that those who protest against this phrase are taking sides with migrants in conflict with the law, in a futile attempt to cover up what is going on. On the contrary: the very idea that a person can be illegal is <\/span><a href=\"http:\/\/mighealth.net\/eu\/images\/e\/ec\/Chol.pdf\"><span style=\"font-weight: 400\">incompatible with the rule of law<\/span><\/a><span style=\"font-weight: 400\">, which is founded on the idea that everyone<\/span> <span style=\"font-weight: 400\">has the right to due process and is equal in the eyes of the law. Labelling a person as \u201cillegal\u201d insinuates that their very <\/span><i><span style=\"font-weight: 400\">existence<\/span><\/i><span style=\"font-weight: 400\"> is unlawful. For this reason, <\/span><span style=\"font-weight: 400\">bodies including the United Nations General Assembly, International Organization for Migration, Council of Europe, and European Commission<\/span> <a href=\"http:\/\/www.fmreview.org\/destination-europe\/pace-severance.html\"><span style=\"font-weight: 400\">have all deemed the phrase unacceptable<\/span><\/a><span style=\"font-weight: 400\">, recommending instead the terms \u201cirregular\u201d or \u201cundocumented\u201d. It would be more than appropriate for the medical profession, given its social standing and influence, to do the same.<\/span><\/p>\n<p><span style=\"font-weight: 400\">While people cannot be illegal, actions can: but here too, words have to be chosen carefully. For example, the <\/span><a href=\"http:\/\/blogs.lse.ac.uk\/politicsandpolicy\/irregular-migration-10-questions-answered\/\"><span style=\"font-weight: 400\">overwhelming majority<\/span><\/a><span style=\"font-weight: 400\"> of irregular migrants have not entered the country clandestinely; they have either had their asylum application turned down, or have \u201coverstayed\u201d a visa, or breached its conditions. Moreover, it is never correct to label someone\u2019s actions \u201cillegal\u201d before the appropriate legal authority has determined that they are. Until then, the presumption of innocence should apply. Due process must have been followed, including the right to legal advice, representation, and appeal\u2014rights that the UK government, especially where migrants are concerned, has been only too willing to <\/span><a href=\"https:\/\/www.ft.com\/content\/02c95b0e-4d43-11e8-8a8e-22951a2d8493\"><span style=\"font-weight: 400\">sacrifice on the altar of cost-cutting<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Even after an official determination that a person is residing unlawfully, we must have confidence in the fairness of the procedures followed before it is safe to assume that the decision was correct. This confidence has been badly shaken by the recent finding that almost half of the UK Home Office\u2019s immigration decisions that go to appeal <\/span><a href=\"https:\/\/www.bbc.com\/news\/uk-politics-43737542\"><span style=\"font-weight: 400\">are overturned<\/span><\/a><span style=\"font-weight: 400\">. In their zeal to implement the government\u2019s policy of creating a \u201chostile environment\u201d for people residing unlawfully, some Home Office officials appear to have forgotten that the rule of law still applies in Britain. People who had lived legally in the UK for decades have been suddenly branded as \u201cillegally resident\u201d and denied healthcare because they couldn\u2019t provide<\/span> <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-43795077\"><span style=\"font-weight: 400\">four pieces of evidence for each year of residence since they arrived<\/span><\/a><span style=\"font-weight: 400\">\u2014<\/span><span style=\"font-weight: 400\">even when some of the evidence had been destroyed by the Home Office itself. Hundreds of highly skilled migrants including doctors have been denied the right to remain in the UK because <\/span><a href=\"https:\/\/www.freemovement.org.uk\/tax-discrepancies-paragraph-322-5-refusals-what-are-they-how-to-challenge-them\/\"><span style=\"font-weight: 400\">minor tax or income discrepancies were taken as evidence of their undesirability<\/span><\/a><span style=\"font-weight: 400\"> under the new Immigration Rules.<\/span> <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/home-news\/immigration-uk-home-office-child-separation-detention-centre-migrants-a8442716.html\"><span style=\"font-weight: 400\">A recent case<\/span><\/a><span style=\"font-weight: 400\"> in which the Home Office separated a 3-year-old girl from her only available parent, in contravention of its own policies, led to an award for damages of \u00a350,000.<\/span><\/p>\n<p><span style=\"font-weight: 400\">What of the medical profession\u2019s own involvement? The 2014 Immigration Act links a person\u2019s healthcare entitlement to their residency status. Health professionals in the UK <\/span><a href=\"http:\/\/www.docsnotcops.co.uk\/facts\/\"><span style=\"font-weight: 400\">are now required to satisfy themselves<\/span><\/a><span style=\"font-weight: 400\"> that an individual is eligible for NHS care by virtue of being \u201cordinarily resident in the UK,\u201d <\/span><a href=\"http:\/\/www.landmarkchambers.co.uk\/userfiles\/documents\/resources\/DOC%20Immigration%20Act.pdf\"><span style=\"font-weight: 400\">the definition of which has been narrowed<\/span><\/a><span style=\"font-weight: 400\">. <\/span><span style=\"font-weight: 400\">In practice, this has meant that people who do not fit certain stereotypes are more likely to be questioned<\/span><span style=\"font-weight: 400\">\u2014<\/span><span style=\"font-weight: 400\">a potential route to an institutionally racist system. They can instantly be denied not only healthcare, but also the ability to work, hold a bank account or driver\u2019s licence, or rent accommodation. It is unprecedented, and unacceptable, for UK health professionals to be conscripted as agents of state control in this way.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Given the unrelenting vendetta of sections of the British press against people who may be residing unlawfully, it should also be borne in mind that such migrants cannot \u201csponge off the welfare state\u201d, since there are virtually no benefits they can claim. They are routinely exposed to exploitation and abuse by employers, while \u201cfree choice\u201d has often played a minimal role in creating their situation. (Consider, for example, migrants who lose their right of residence as a result of losing their job, or asylum seekers whose claim has been rejected but cannot return to their country because it is unsafe or refuses to accept them). <\/span><\/p>\n<p><span style=\"font-weight: 400\">To sum up: abolishing the dehumanising term \u201cillegal migrant\u201d is an important first step, but the responsibility of health professionals goes even further. In the UK they are obliged to collaborate in the implementation of current immigration policy. To be able to do this with a clear conscience, they need to know that rights to residence in the UK are administered justly and humanely.
