{"id":42692,"date":"2018-07-24T10:19:19","date_gmt":"2018-07-24T09:19:19","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=42692"},"modified":"2018-08-07T17:31:37","modified_gmt":"2018-08-07T16:31:37","slug":"why-were-giving-our-ebola-medals-back-to-the-uk-government","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2018\/07\/24\/why-were-giving-our-ebola-medals-back-to-the-uk-government\/","title":{"rendered":"Why we\u2019re giving our &#8220;Ebola Medals&#8221; back to the UK government"},"content":{"rendered":"<p><span style=\"font-weight: 400\"><a href=\"https:\/\/blogs.bmj.com\/bmj\/files\/2018\/07\/ebola_analysis.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-42693\" src=\"https:\/\/blogs.bmj.com\/bmj\/files\/2018\/07\/ebola_analysis-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/a>We were extremely proud to represent the UK and the NHS in the government\u2019s response to the Ebola epidemic in West Africa in 2014\/5, and were honoured with medals for our involvement. This was not an individual achievement, but a point of national pride, recognising the humanitarian role that the UK played.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, since then, the government that rewarded us for crossing borders to help patients is increasingly creating <\/span><span style=\"font-weight: 400\">borders between us and our patients<\/span><span style=\"font-weight: 400\">, culminating in the 70th anniversary of the NHS having<\/span><span style=\"font-weight: 400\">\u00a0the most restrictive and regressive charging regulations in NHS history. These regulations undermine the principles and values that inspired the work for which we were given medals, and we feel we can no longer keep our medals in good faith.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The<\/span><a href=\"https:\/\/www.theguardian.com\/uk-news\/video\/2018\/apr\/17\/who-are-the-windrush-generation-video-explainer\"> <span style=\"font-weight: 400\">Windrush scandal<\/span><\/a><span style=\"font-weight: 400\"> brought the effects of the government\u2019s<\/span><a href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/apr\/17\/theresa-mays-hostile-environment-policy-at-heart-of-windrush-scandal\">\u00a0&#8220;<span style=\"font-weight: 400\">Hostile environment\u2019&#8221;<\/span><\/a><span style=\"font-weight: 400\"> agenda onto the front pages. The <\/span><a href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/mar\/22\/theresa-may-refuses-to-intervene-over-mans-54000-nhs-cancer-bill-albert-thompson\"><span style=\"font-weight: 400\">denial of NHS care<\/span><\/a><span style=\"font-weight: 400\">, which was always meant to be &#8220;free at the point of use&#8221; was a central injustice. We thought the underlying NHS charging regulations would be withdrawn, but they remain in place, continuing to act as a barrier to healthcare for many others. \u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In particular, the most recent regulations,<\/span><a href=\"https:\/\/www.doctorsoftheworld.org.uk\/Handlers\/Download.ashx?IDMF=f6a9d7c2-a526-4d61-ae2d-d4807f9f99f3\"> <span style=\"font-weight: 400\">opposed by 193 organisations in a letter to the Secretary of State<\/span><\/a><span style=\"font-weight: 400\">, but nevertheless<\/span><a href=\"http:\/\/www.legislation.gov.uk\/uksi\/2017\/756\/contents\/made\"> <span style=\"font-weight: 400\">enshrined into law in October 2017,<\/span><\/a><span style=\"font-weight: 400\"> are currently being rolled out in England. They build upon increasingly stringent changes to legislation relating to NHS entitlement and charging, particularly in<\/span><a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2014\/22\/contents\/enacted\"><span style=\"font-weight: 400\"> 2014<\/span><\/a><span style=\"font-weight: 400\">, and<\/span><a href=\"http:\/\/www.legislation.gov.uk\/uksi\/2015\/238\/pdfs\/uksi_20150238_en.pdf\"> <span style=\"font-weight: 400\">2015<\/span><\/a><span style=\"font-weight: 400\">, and now enforce a charge of 150% of the cost of the treatment to anybody unable to prove their immigration status. The charges apply to secondary care and a range of community services, and treatment must be withheld, unless deemed &#8220;urgent or immediately necessary&#8221;, in which case charges are applied later.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Healthcare workers across the country are witnessing patients being denied or deterred from care with devastating consequences, including pregnant women and children. Many of the negative effects remain unseen, as people are deterred from seeking help due to charges, or for fear of arrest, detention, and deportation. Only recently have a few cases started to receive media attention, whether it be<\/span><a href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/mar\/10\/denied-free-nhs-cancer-care-left-die-home-office-commonwealth\"><span style=\"font-weight: 400\"> patients denied cancer care;<\/span><\/a><a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/refugees-chemotherapy_uk_5b084bbae4b0fdb2aa537379?utm_hp_ref=uk-refugees\"><span style=\"font-weight: 400\"> refugees having chemotherapy stopped;<\/span><\/a><a href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/jun\/07\/home-office-prevented-asylum-seekers-urgent-cancer-treatment\"><span style=\"font-weight: 400\"> home office decisions preventing life saving treatments for asylum seekers;<\/span><\/a><span style=\"font-weight: 400\"> others<\/span><a href=\"https:\/\/www.independent.co.uk\/news\/uk\/politics\/domestic-worker-death-woman-too-scared-access-healthcare-a8162771.html\"><span style=\"font-weight: 400\"> dying at home due to fear of charges;<\/span><\/a><span style=\"font-weight: 400\"> or<\/span><a href=\"https:\/\/www.theguardian.com\/uk-news\/2017\/mar\/20\/pregnant-asylum-seekers-refugees-afraid-seek-nhs-maternity-care\"><span style=\"font-weight: 400\"> pregnant women deterred from maternity care<\/span><\/a><span style=\"font-weight: 400\"> with potentially life-long consequences for themselves and their babies. These are the tip of the iceberg, as fear prevents consent for publishing stories, either in academia or the media.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In theory, exemptions exist for vulnerable groups, such as asylum seekers, refugees,\u00a0victims of trafficking and modern day slavery. However, <\/span><a href=\"https:\/\/www.doctorsoftheworld.org.uk\/Handlers\/Download.ashx?IDMF=2a7fc733-ceef-4417-9783-d69b016ff74f\"><span style=\"font-weight: 400\">there is evidence that people in all of these categories have been denied or deterred from treatment<\/span><\/a><span style=\"font-weight: 400\">. Also problematic are specific exemptions for infectious diseases, as patients come with symptoms, not diseases, and deterrence due to charging will frustrate early diagnosis and treatment,<\/span><a href=\"https:\/\/www.independent.co.uk\/news\/health\/hostile-environment-windrush-hiv-tuberculosis-immigrant-home-office-a8315051.html\"> <span style=\"font-weight: 400\">leading to potential public health problems.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400\">The regulations are designed to deter those without legal status (undocumented migrants) from accessing healthcare, turning our hospitals into an extension of immigration enforcement. However, even if this were ever an acceptable aim, immigration status is fluid and can change overnight, and we know that our immigration system is seriously flawed, <\/span><a href=\"https:\/\/www.ft.com\/content\/a1c45578-585c-11e8-b8b2-d6ceb45fa9d0\"><span style=\"font-weight: 400\">even deporting and detaining UK citizens<\/span><\/a><span style=\"font-weight: 400\">, and with <\/span><a href=\"https:\/\/www.statista.com\/statistics\/459796\/asylum-acceptance-rate-in-selected-european-countries\/\"><span style=\"font-weight: 400\">low asylum acceptance rates<\/span><\/a><span style=\"font-weight: 400\">. Using this system to determine NHS treatment is unsafe, and should not fall onto the responsibility of a hospital.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Documents or not, access to healthcare is a human right, irrespective of the legal status of a patient. <\/span><a href=\"https:\/\/www.doctorsoftheworld.org.uk\/Handlers\/Download.ashx?IDMF=ae5edfbb-31cf-48c9-b79c-4492b3ee29fa\"><span style=\"font-weight: 400\">Many of our neighbours in Europe<\/span><\/a><span style=\"font-weight: 400\"> recognise this and provide free primary and secondary healthcare for undocumented migrants, especially pregnant women and children. France, for example, explicitly funds a programme dedicated to ensuring full health coverage of undocumented migrants<\/span><a href=\"http:\/\/www.cmu.fr\/undocumented-immigrant.php\"> <span style=\"font-weight: 400\">(Aide M\u00e9dicale de l\u2019Etat)<\/span><\/a><span style=\"font-weight: 400\">. By contrast, The UK now funds a programme with the intention of detecting and denying care to undocumented migrants (unless they pay 150% costs), and is breaching international human rights law<\/span><a href=\"http:\/\/www.refworld.org\/pdfid\/4538838d0.pdf\"> <span style=\"font-weight: 400\">(CECSR, Art 12)<\/span><\/a><span style=\"font-weight: 400\"> including the rights of a child<\/span><a href=\"https:\/\/www.unicef.org\/crc\/files\/Rights_overview.pdf\"> <span style=\"font-weight: 400\">(UNCRC, Art 24). \u00a0<\/span><\/a><span style=\"font-weight: 400\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The grossly exaggerated and misleading concept of &#8220;health tourism&#8221; is a stated justification for the policies. However, estimates of this cost are<\/span><a href=\"http:\/\/www.thelancet.com\/pdfs\/journals\/lancet\/PIIS0140-6736(17)33302-0.pdf\"> <span style=\"font-weight: 400\">between 0.00016%<\/span><\/a><span style=\"font-weight: 400\"> and<\/span><a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/251909\/Quantitative_Assessment_of_Visitor_and_Migrant_Use_of_the_NHS_in_England_-_Exploring_the_Data_-_FULL_REPORT.pdf\"> <span style=\"font-weight: 400\">0.3% of the NHS budget according to government estimates<\/span><\/a><span style=\"font-weight: 400\">, and<\/span><a href=\"https:\/\/www.kingsfund.org.uk\/projects\/verdict\/what-do-we-know-about-impact-immigration-nhs\"> <span style=\"font-weight: 400\">(0.07% quoted by the King\u2019s Fund<\/span><\/a><span style=\"font-weight: 400\">). Indeed when targeted pilots were carried out including hospitals which were perceived to have large numbers of &#8220;health tourists,&#8221;<\/span><a href=\"https:\/\/www.standard.co.uk\/news\/health\/8900-checks-on-nhs-health-tourists-find-just-50-liable-to-pay-a3850121.html\">\u00a0<span style=\"font-weight: 400\">only 1 in 180 patients<\/span><\/a> <span style=\"font-weight: 400\">were found to be chargeable (total sample 8,900). Many have argued that the regulations may actually cost more than they save, due to bureaucracy, missed preventive and secondary care leading to complications and greater costs with an<\/span> <a href=\"https:\/\/www.bmj.com\/content\/359\/bmj.j4713\"><span style=\"font-weight: 400\">increasing burden on emergency and primary care<\/span><\/a><span style=\"font-weight: 400\">, and worsening public health from undiagnosed and untreated infectious diseases. \u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">We want the government to remove the hostile environment from the NHS. We\u2019re asking for the upfront charging regulations that came in to law in \u00a0October 2017 to be repealed, pregnant women and children to be exempt, and for the charging system to suspended pending an independent public health impact assessment with a particular focus on vulnerable groups.<\/span><\/p>\n<p><em><strong>Neal Russell<\/strong> is an NHS paediatric registrar, and ex-Ebola worker who worked Sierra Leone.\u00a0<\/em><\/p>\n<p><em><strong>Kevin Wing<\/strong> is an assistant professor of epidemiology at the London School of Hygiene and Tropical Medicine.<\/em><\/p>\n<p><em><strong>Gill Goldberg<\/strong>\u00a0worked in Cameroon in a development role, then in South Sudan for MSF, before going to Sierra Leone during the Ebola outbreak.
