{"id":42384,"date":"2018-06-18T17:27:15","date_gmt":"2018-06-18T16:27:15","guid":{"rendered":"https:\/\/blogs.bmj.com\/bmj\/?p=42384"},"modified":"2018-06-22T17:08:04","modified_gmt":"2018-06-22T16:08:04","slug":"whither-the-who-code-in-the-scrap-the-cap-campaign","status":"publish","type":"post","link":"https:\/\/blogs.bmj.com\/bmj\/2018\/06\/18\/whither-the-who-code-in-the-scrap-the-cap-campaign\/","title":{"rendered":"Whither the WHO Code in the Scrap the Cap campaign?"},"content":{"rendered":"<p><span style=\"font-weight: 400\">In 2010 the UK adopted the World Health Organization\u2019s <\/span><a href=\"http:\/\/www.who.int\/hrh\/migration\/code\/code_en.pdf?ua=1\"><span style=\"font-weight: 400\">Global Code of Practice on the International Recruitment of Health Personnel<\/span><\/a><span style=\"font-weight: 400\">, an important international agreement on which the recently successful <a href=\"https:\/\/www.bmj.com\/scrap-the-cap\">Scrap the Cap campaign<\/a> is silent. The Code states a number of principles that member states should follow. Member states should \u201ccreate a sustainable health workforce and work towards establishing effective health workforce planning\u2026that will reduce their need to recruit migrant health personnel\u201d (Article 3.6), while \u201cthe health systems of both source and destination countries should derive benefits from the international migration of health personnel\u201d (Article 5.2). Destination countries (in this instance the UK) are encouraged to collaborate with source countries (in this instance those outside the European Economic Area) to strengthen source countries\u2019 own \u201chealth human resource development and training\u201d (Article 5.1). \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">It may seem churlish to quote a voluntary Code in a context where the UK\u2019s tier 2 skilled worker visa cap was preventing the NHS from filling vacant positions with non-EEA physicians, creating real (or at least strongly argued) risks to the health of British citizens. The British Medical Association, while supporting the campaign, at least noted that \u201c<\/span><a href=\"https:\/\/www.bmj.com\/content\/361\/bmj.k2461.full\"><span style=\"font-weight: 400\">The real reason we have so many vacancies in the NHS is because of poor workforce planning and inadequate investment<\/span><\/a>.<span style=\"font-weight: 400\">\u201d This statement calls attention to the failure of the UK to abide by the Code\u2019s Article 3.6, a legacy, in part, of <\/span><a href=\"https:\/\/www.rcn.org.uk\/news-and-events\/news\/hunt-the-cap-has-been-scrapped\"><span style=\"font-weight: 400\">the UK public sector pay cap<\/span><\/a><span style=\"font-weight: 400\"> and marketization reforms that have driven many dissatisfied UK-trained <\/span><a href=\"https:\/\/www.theguardian.com\/society\/2018\/jan\/17\/nhs-england-hospital-staffing-one-in-10-nurses-quit-each-year\"><span style=\"font-weight: 400\">nurses<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.mirror.co.uk\/news\/politics\/gps-leaving-nhs-doctors-reveal-11978183\"><span style=\"font-weight: 400\">doctors<\/span><\/a><span style=\"font-weight: 400\"> out of an unhealthily stressful environment. Although the recent promise of new NHS funding might reverse this outflow and reduce the need for international recruits, there remains an unselfconscious acceptance that \u201c<\/span><a href=\"https:\/\/www.bmj.com\/bmj\/section-pdf\/978249?path=\/bmj\/361\/8155\/This_Week.full.pdf\"><span style=\"font-weight: 400\">The UK has always relied on and welcomed doctors from overseas<\/span><\/a><span style=\"font-weight: 400\">\u201d. This welcoming extends to internationally trained physicians from countries with health worker densities far below those in the UK, including some (such as India and Nigeria, <\/span><a href=\"http:\/\/www.who.int\/workforcealliance\/countries\/57crisiscountries.pdf\"><span style=\"font-weight: 400\">two of the countries from which UK agencies recruit for the NHS) considered by the WHO to be facing a critical shortage of health human resources<\/span><\/a><span style=\"font-weight: 400\">. This is another clear violation of the Code, which \u201cdiscourages active recruitment of health personnel from developing countries facing critical shortages of health workers\u201d (Article 5.1). <\/span><\/p>\n<p><span style=\"font-weight: 400\">The UK is also committed to the new Sustainable Development Goals (SDGs), one of which is to achieve Universal Health Coverage (UHC) by 2030. Estimates of the health workers needed to achieve this goal show <\/span><a href=\"https:\/\/human-resources-health.biomedcentral.com\/articles\/10.1186\/s12960-015-0056-9\"><span style=\"font-weight: 400\">huge projected deficits in two of the regions from which the UK welcomes internationally trained doctors<\/span><\/a><span style=\"font-weight: 400\">: Asia (primarily India and Pakistan) with a 7 million shortfall, and Africa, with a projected 2.8 million workforce gap. Health worker migration is not the main reason for these deficits\u2014particularly India whose public health spending has stagnated at around 1% of GDP for decades<\/span><a href=\"https:\/\/human-resources-health.biomedcentral.com\/articles\/10.1186\/s12960-017-0199-y\"><span style=\"font-weight: 400\">\u2014although it exacerbates the inabilities of countries in these regions to build or sustain health systems<\/span><\/a><span style=\"font-weight: 400\"> sufficient to provide for their population needs. <\/span><\/p>\n<p><span style=\"font-weight: 400\">The Code is not meant to limit in any way \u201cthe freedom of health personnel\u2026to migrate to countries that wish to admit and employ them\u201d (Article 3.4). It does, however, illustrate the &#8220;perverse subsidy,&#8221; where a destination country\u2019s failure to invest adequately in its own health human resources (thereby incentivizing international recruitment) \u00a0<\/span><a href=\"http:\/\/policyoptions.irpp.org\/fr\/magazines\/border-security\/the-perverse-subsidy-canada-and-the-brain-drain-of-health-professionals-from-sub-saharan-africa\/\"><span style=\"font-weight: 400\">profits from the training costs (often publicly paid or subsidized) of health workers<\/span><\/a><span style=\"font-weight: 400\"> migrating from often heavily disease-burdened and understaffed countries. The economic gains to wealthier destination countries and <\/span><a href=\"https:\/\/www.bmj.com\/content\/343\/bmj.d7031\"><span style=\"font-weight: 400\">training cost losses to poorer ones can be substantial<\/span><\/a><span style=\"font-weight: 400\">. Remittances from \u00e9migr\u00e9 health workers, while important, do not directly compensate health systems or exporting countries\u2019 taxpayers for the departure of their skilled staff. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Although limited and unenforceable, the Code arose from a recognition that persisting global imbalances in wealth and health is what drives the skilled health worker migration, placing a greater burden of responsibility on wealthier nations that benefit most from such flows. This persisting inequitable exchange inevitably\u00a0<\/span><a href=\"https:\/\/www.socialeurope.eu\/globalisation-new-deal-on-labour-mobility\"><span style=\"font-weight: 400\">demands a new accord on international labour mobility<\/span><\/a><span style=\"font-weight: 400\">, whereby redistributed <\/span><a href=\"https:\/\/www.cgdev.org\/sites\/default\/files\/global-skill-partnerships-proposal-technical-training-in-mobile-world-brief.pdf\"><span style=\"font-weight: 400\">financial resources become available for the training and retention of skilled health workers in source countries<\/span><\/a><span style=\"font-weight: 400\">. Options for such an accord are currently being considered in UN negotiations for a <\/span><a href=\"https:\/\/refugeesmigrants.un.org\/sites\/default\/files\/180326_draft_rev1_final.pdf\"><span style=\"font-weight: 400\">Global Compact on Migration<\/span><\/a><span style=\"font-weight: 400\">. <\/span><\/p>\n<p><span style=\"font-weight: 400\">While awaiting such international measures, and with the &#8220;Cap now Scrapped,&#8221; the UK government needs to adopt measures to ensure that the health systems of underserved countries from which the NHS receives its new doctors also benefit, and that they do so at least proportionately.
