It was a landmark decision grounded in science and human rights that will go into effect next month.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">The law that was repealed had violated people\u2019s fundamental human rights by perpetuating stigma, discrimination, and abuse. It was overwhelmingly used to prosecute marginalised people, with\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__williamsinstitute.law.ucla.edu_headlines_hiv-2Dcriminal-2Dlaws-2Daffect-2Dmarginalized-2Dcommunities_&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=1KsgUKwYPW8LdzVI522J9wYTATFCTb28_f85NvDolqk&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">90% of convictions<\/span><\/a>\u00a0in recent years targeting sex workers or women suspected of sex work.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Repealing the law was also a success for science: people on antiretroviral treatments have\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__www.cdc.gov_hiv_library_dcl_dcl_092717.html&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=i7F6b0XGNbvQ-SF7fhtFl7O6lhvmDBOuQ87CyGAZUjU&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">virtually undetectable viral loads<\/span><\/a>, meaning they cannot transmit HIV to others. With such effective medicines available, supporting people to get tested and on treatment is a critical step to ending the HIV\/AIDS epidemic.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Yet, there are still over thirty states in the United States\u2014and countless countries around the world\u2014with HIV criminalisation laws, which penalise people for seeking testing and treatment.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Advocates, including law professors, throughout the state of California were successful in getting the bill, SB 239, to the Governor\u2019s desk.\u00a0It\u2019s time for advocates and legislators in the United States, and around the world, to follow California\u2019s example and base their response to HIV\/AIDS on science and human rights.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Since the 1980s, there has been remarkable progress in battling HIV thanks to efforts by advocates, scientists, donors, and governments to reduce stigma, encourage prevention, and increase access to lifesaving medicines. Deaths from AIDS have\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=http-3A__www.unaids.org_en_resources_fact-2Dsheet&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=d8rr2K5SqgV7Ngc64oL64YpjIEP9vl8PN5Qwcf2KKAY&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">fallen by 48%<\/span><\/a>\u00a0since the peak of the epidemic and nearly 20 million people around the world have access to lifesaving antiretroviral drugs.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">However, despite these triumphs, there are still millions of people around the world who urgently need antiretroviral drugs, but can\u2019t access them often because of archaic laws founded on fear and stigma. Too often, the people who don\u2019t receive medicines are the ones who need them most\u2014including sex workers, transgender people, and drug users. In the United States, and many other countries outside sub-Saharan Africa, these groups account for\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=http-3A__www.unaids.org_en_topic_key-2Dpopulations&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=LPe1Yey0hEybpvYeQSOP-xEe1B8w50EvfMZ9V7jYYE4&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">80% of new HIV infections<\/span><\/a>.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">This means it\u2019s especially important to offer support to people who are marginalised, including encouraging them to seek out testing for HIV and receive the care they need and deserve. Unfortunately, existing laws may not be helpful, particularly when they criminalise people\u2019s behaviours and sanction discriminatory practices.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Legislation that criminalises the behavior of people who are at high risk for HIV infection\u2014like laws that prohibit drug users from accessing sterile needles\u2014still exist in the majority of US states. In fact, in\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=http-3A__lawatlas.org_datasets_syringe-2Dpolicies-2Dlaws-2Dregulating-2Dnon-2Dretail-2Ddistribution-2Dof-2Ddrug-2Dparapherna&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=RJ52uUDXgIiLXAam9dOvl5Lxc3XCCiKjFc-kwT99TbM&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">more than 30 states<\/span><\/a>, simply having a needle in one\u2019s possession is illegal. But if drug users can\u2019t carry or access safe and sterile needles, they\u2019re more likely to have to share needles and are at higher risk for contracting HIV and other blood-borne diseases.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Similarly, in several states, sex workers are discouraged from visiting healthcare providers or reporting violence to the police out of fear of prosecution. But this means they\u2019re put in a position where they effectively have no rights, with horrendous impacts on their lives, health, and wellbeing.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">The\u00a0<a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__hivlawcommission.org_&amp;d=DwMGaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=APmIzxgbFuUKJhGPQF1xDO1JBY49KQ0Zcj092wFYgybXdrS8Sj_7WyT69K_l-7fT&amp;m=lIUQKlOAimgl93RVdTy0-IGnAZFaOeP5tqdq-Nt5V5Y&amp;s=m_ysFkPug9CZidPo8MYbT1aNMt0CYhly5UW-Ttl6OGk&amp;e=\" target=\"_blank\" rel=\"noopener\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s6\">Global Commission on HIV and the Law<\/span><\/a>\u00a0has examined the relationship between HIV and the law in countries around the world and found that replacing punitive laws with legislation that prohibits discrimination and protects fundamental human rights can create safe, enabling environments where people are encouraged to seek and receive testing and treatment.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">So, what exactly do these laws look like?<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Firstly, we need laws that actively prohibit discrimination against people living with HIV. It\u2019s imperative that people can seek testing, treatment, and disclose any potential risk factors without fear of being reported.<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">Secondly, laws that protect the fundamental human rights of every single person\u2014including laws that recognise the rights of transgender people, prohibit discrimination based on sexual orientation, and decriminalise sex work and drug use\u2014are essential to end the HIV epidemic.\u00a0<\/span><\/p>\n<p class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-p1\"><span class=\"m_3913013884651838380m_8881987063534598475gmail-m_1970888470920352941m_7224308587546552060gmail-s1\">In recent years, countries ranging from Peru, to Botswana, to Kenya, have reformed their laws and policies to protect the rights of people living with HIV.
